Are people who have the same registered permanent residence address and the same registered temporary residence address eligible for family-based health insurance?
What is health insurance?
Pursuant to Clause 1 Article 2 of the Law on Social Insurance 2008 of Vietnam (amended by Clause 1 Article 1 of Amendments to the Law on Health Insurance 2014 of Vietnam):
“Health insurance is a form of compulsory insurance which is implemented by the State to look after the health of the insured according to this Law for non-profit purposes.”
What are the health insurance principles?
Pursuant to Article 3 of the Law on Social Insurance 2008 of Vietnam (amended by Clause 2 Article 1 of Amendments to the Law on Health Insurance 2014 of Vietnam) on health insurance principles:
- Ensuring the sharing of risks among the insured.
- Health insurance rates shall be determined according to the percentage of the wages as the basis for paying for the compulsory health insurance in accordance with the Law on Health insurance (hereinafter referred to as monthly salaries), retirement pensions, allowances or base salaries.
- Benefit levels depend on the seriousness of sickness, groups of the insured within the scope of the benefits and the period of time that the insured pay health insurance.
- Costs of health insurance-covered medical care shall be jointly paid by the health insurance fund and the insured.
- The health insurance fund shall be managed in a centralized, unified, public and transparent manner, ensuring the balance between revenue and expenditure, and be protected by the State.
Are people who have the same registered permanent residence address and the same registered temporary residence address eligible for family-based health insurance?
Group of family-based health insurance policyholders
Pursuant to Article 5 of Decree 146/2018/ND-CP of Vietnam on group of family-based health insurance policyholders:
- Persons whose names are inscribed in family household records, except those subjects specified in Article 1, 2, 3, 4 and 6 hereof.
- Persons whose names are inscribed in temporary residence records, except those specified in Article 1, 2, 3, 4 and 6 hereof and those already participating in health insurance as prescribed in clause 1 of this Article.
- The following persons eligible for family-based participation in health insurance:
+ Dignitaries, sub-dignitaries and clergy;
+ Persons residing in social relief establishments, except for those defined in Articles 1, 2, 3, 4 and 6 hereof without health insurance contributions supported by the state budget.
Besides, identification of health insurance payers, amount and reduction for family-based model is guided by Article 4 of Circular 30/2020/TT-BYT of Vietnam:
“Article 4. Identification of health insurance payers, amount and reduction for family-based model
1. Identification of individuals specified under Clause 3 Article 5 of Decree No. 146/2018/ND-CP depends on following documents:
a) For dignitaries, sub-dignitaries and clergy: family register or temporary residence register or lists bearing seals of religious organizations directly overseeing dignitaries, sub-dignitaries and clergy;
b) Persons residing in social security facilities: family register or temporary residence register or lists bearing seals of social security facilities where the individuals are residing.
2. Reduction of health insurance amount for individuals under Article 5 of Decree No. 146/2018/ND-CP shall be implemented as soon as a second individual whose name is included in family register or temporary residence register or list bearing seal of religious organizations, social security facilities specified under Clause 1 of this Article participate in family-based health insurance.”
Are people who have the same registered permanent residence address and the same registered temporary residence address eligible for family-based health insurance?
Pursuant to Point a Clause 3 Article 1 of the Draft Decree amending Decree 146/2018/ND-CP of Vietnam guiding the Law on Health Insurance (Draft 1):
“3. To amend and supplement a number of clauses of Article 5 as follows:
a) To amend and supplement Clauses 1 and 2 as follows:
1. Persons who have the same registered permanent residence address and the same registered temporary residence address at a legal residence in accordance with the law on residence, except for those specified in Article 1, 2, 3, 4 and 6 of this Decree.
2. Persons who have the same registered temporary residence address at a legal residence in accordance with the law on residence, except for the subjects specified in Article 1, 2, 3, 4 and 6 of this Decree and the subjects who have participated health insurance as prescribed in Clause 1 of this Article.
... "
Thus, according to the above provisions, when the Draft Decree amending Decree 146/2018/ND-CP guiding the Law on Health Insurance is issued and comes into effect, the persons who have the same registered permanent residence address and the same registered temporary residence address at a legal residence in accordance with the law on residence are eligible for family-based health insurance.
