Is it correct that examiners in the military enforcement sector are exempt from foreign language and computer certificates from 2023?

Based on the provisions of Article 12 Circular 19/2018/TT-BQP as amended by Clause 4, Article 1 of Circular 10/2023/TT-BQP stipulates as follows:

Standards

1. Examiner:

a) Active-duty officers and professional soldiers meeting the standards as prescribed in Article 4 of this Circular;

b) Possessing at least a bachelor's degree in law;

c) Having not less than 03 years (36 months) of legal work experience;

d) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

2. Principal Examiner:

a) Active-duty officers meeting the standards as prescribed in Article 4 of this Circular;

b) Having held the rank of Examiner or equivalent for not less than 09 years, of which the Examiner rank must be held for at least 01 year (12 months) as of the date of appointment proposal;

c) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

3. Senior Examiner:

a) Active-duty officers meeting the standards as prescribed in Article 4 of this Circular;

b) Having held the rank of Principal Examiner or equivalent for not less than 06 years (72 months), of which the Principal Examiner rank must be held for at least 01 year (12 months) as of the date of appointment proposal;

c) Holding a diploma in advanced political theory or advanced political-administrative theory or a bachelor's degree in politics or a confirmation of advanced political theory level;

d) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

4. In case of cadre transfer from the Prosecutor's Office, Court, Investigation, Legal, Inspection, Coast Guard, Border Guard, Military Security Protection, Military Regional Execution Department to the Department of Civil Judgment Enforcement of the Ministry of Defense to be appointed as Director, Deputy Director of the Department; Head of Division, Deputy Head of the Division, shall be considered for appointment to the ranks of Examiner equivalent to the held position according to legal regulations.

According to the above provisions, Circular 10/2023/TT-BQP compared to Circular 19/2018/TT-BQP has exempted foreign language and computer certificates in the standards for examiners in the military enforcement sector.

Thus, from March 16, 2023, the standards for examiners in the military enforcement sector are regulated as follows:

Examiner

- Active-duty officers and professional soldiers meeting the standards as prescribed;- Possessing at least a bachelor's degree in law;- Having not less than 03 years (36 months) of legal work experience;- Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

Principal Examiner

Standards and Conditions for Appointment and Dismissal

1. Standards and conditions for appointment:

a) Active-duty officers and professional soldiers meeting the standards as prescribed in Article 4 of this Circular;

b) Possessing at least a bachelor's degree in law;

c) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

According to the above provisions, Circular 10/2023/TT-BQP has also amended the criteria for the position of enforcement secretary.

The latest criteria for the position of enforcement secretary are as follows:

- Active-duty officers and professional soldiers meeting the standards as prescribed;- Possessing at least a bachelor's degree in law;- Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

b) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

2. Intermediate Enforcement Officer:

a) Meeting the standards as prescribed in Clause 5, Article 18 of the Law on Civil Judgment Enforcement and Article 4 of this Circular;

b) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

3. Senior Enforcement Officer:

a) Meeting the standards as prescribed in Clause 5, Article 18 of the Law on Civil Judgment Enforcement and Article 4 of this Circular;

b) Holding a diploma in advanced political theory or advanced political-administrative theory, or a bachelor's degree in politics, or a confirmation of advanced political theory level;

c) Holding a certificate in state management and civil execution skills training per the Ministry of Justice's content and program.

Compared to the provisions of Article 9 of Circular 19/2018/TT-BQP, it can be seen that Circular 10/2023/TT-BQP has exempted foreign language and computer certificates in the standards for enforcement officers in the military enforcement sector.

Circular 10/2023/TT-BQP will be effective from March 16, 2023.
