Based on Clause 6, Article 4 of Circular 38/2022/TT-BTC supplemented by Article 6 of Circular 63/2023/TT-BTC as follows:
Fee Rate

6. In case an organization submits an application for the issuance of a construction activity capacity certificate, an individual submits an application for the issuance of construction permits, or a foreign contractor submits an application for the issuance of a construction permit online:
a) From January 1, 2024, to December 31, 2025, apply a fee rate of 80% (eighty percent) of the fee rate specified in Clauses 1 and 3 of this Article.
b) From January 1, 2026, onwards, apply the fee rate specified in Clauses 1 and 3 of this Article.
From January 1, 2024, to December 31, 2025, the fee for issuance of construction permits, an individual submitting an application for the issuance of construction permits, or a foreign contractor submitting an application for the issuance of a construction permit online is as follows:
- Construction activity capacity certificate for organizations: 800,000 VND/certificate.
- Construction practice certificate for individuals: 240,000 VND/certificate.
- Fee for the issuance of construction permits for foreign contractors: 1,600,000 VND/permit.
From January 1, 2026, the fee rate will be implemented according to Circular 38/2022/TT-BTC.

According to Article 90 of Construction Law 2014, the regulations are as follows:
Main Contents of a Construction Permit
1. Project name.
2. Name and address of the investor.
3. Location and site of the construction project; construction line for linear projects.
4. Type and grade of the construction project.
5. Construction elevation.
6. Red-line boundary, construction boundary.
7. Construction density (if any).
8. Land use coefficient (if any).
9. For civil, industrial, and single-family house projects, in addition to the contents specified from Clauses 1 to 8 of this Article, the total construction area, ground floor area (first floor), number of floors (including basements, attics, technical floors, and rooftops), and the maximum height of the entire project must also be included.
10. The construction start period must not exceed 12 months from the date of issuance of the construction permit.

- Project name.
- Name and address of the investor.
- Location and site of the construction project; construction line for linear projects.

Based on Article 95 of Construction Law 2014, the following are stipulated:
Documents for New Construction Permit Application
1. The application dossier for a new construction permit for a detached house includes:
a) Application form for a construction permit;
b) A copy of one of the documents proving land use rights as prescribed by land law;
c) Construction design drawings;
d) For construction projects with adjacent buildings, a commitment to ensure the safety of the adjacent buildings must be included.
2. The application dossier for a construction permit for non-linear projects includes:
a) Application form for a construction permit;
b) A copy of one of the documents proving land use rights as prescribed by land law;
c) An approved project decision, investment decision;
d) Construction design drawings;
dd) Declaration of the qualifications and experience of the design organization and the individual who is the chief designer or project manager, along with a copy of the practicing certificate of the chief designer or project manager.
3. The application dossier for a construction permit for linear projects includes:
a) Documents specified in points a, c, d, and đ of Clause 2 of this Article;
b) A document of approval from the competent state authority regarding the suitability of the location and route plan;
c) Decision on land acquisition from the competent state authority as prescribed by land law.
The application dossier for a construction permit for a detached house includes:
- Application form for a construction permit.
- A copy of one of the documents proving land use rights as prescribed by land law.
- Construction design drawings.
- For construction projects with adjacent buildings, a commitment to ensure the safety of the adjacent buildings must be included.
