According to the provisions of Article 5 of Decree No. 01/2021/ND-CP on business registration, the right to establish an enterprise and the obligation to register an enterprise are specified as follows:
(1) Establishing an enterprise in accordance with the law is a right of individuals and organizations and is protected by the State.
(2) The founder of an enterprise or an enterprise is obliged to fully and promptly fulfill the obligations on enterprise registration, publicize information on the establishment and operation of the enterprise in accordance with this Decree, and relevant legal documents.
(3) It is strictly forbidden for the Business Registration Office and other agencies to cause trouble to organizations and individuals while receiving dossiers and handling business registration procedures.
(4) Ministries, ministerial-level agencies, People's Councils and People's Committees at all levels are not allowed to issue regulations and documents on business registration applicable to their respective industries or localities. Regulations on business registration promulgated by ministries, ministerial-level agencies, People's Councils and People's Committees at all levels contrary to the provisions of this Decree are not effective.

Certificate of business registration in Vietnam?
