Pursuant to Article 32 of the 2021 Law on Prevention and Control of Narcotic Substances in Vietnam stipulating as follows:

Persons subject to administrative penalty of compulsory rehabilitation in rehabilitation centers
Drug addicts aged 18 or older shall be subject to the administrative penalty of compulsory rehabilitation in rehabilitation centers according to regulations of the Law on Handling Administrative Violations in any of the following cases:
1. They fail to register for, fail to undergo or stop voluntary rehabilitation without permission;
2. They are undergoing voluntary rehabilitation and found to have used a narcotic substance illegally;
3. They are dependent on opioids and fail to register for, fail to undergo or stop opioid substitution therapy without permission or are forced to terminate opioid substitution therapy after committing a violation against regulations on dependence treatment;
4. They relapse while subject to post-rehabilitation management.

Thus, drug addicts aged 18 or older shall be subject to the administrative penalty of compulsory rehabilitation in rehabilitation centers according to regulations of the Law on Handling Administrative Violations in any of the cases specified above.

Pursuant to Article 29 of the 2021 Law on Prevention and Control of Narcotic Substances in Vietnam stipulating rehabilitation procedures as follows:

Rehabilitation procedures in Vietnam
1. Rehabilitation comprises the following stages:
a) Receipt and classification;
b) Rehabilitation, treatment of mental disorders and treatment of other conditions;
c) Education, counseling and behavior and personality recovery;
d) Therapeutic working and vocational training;
dd) Preparation for reintegration into society.
2. Compulsory rehabilitation must carry out all of the stages mentioned in Clause 1 herein; voluntary rehabilitation must complete the stages provided for in Points a, b and c Clause 1 herein.
3. The Government shall elaborate this Article.

Thus, rehabilitation comprises the following stages:

- Rehabilitation, treatment of mental disorders and treatment of other conditions;

From what age should drug addicts not be forced to undergo compulsory rehabilitation in rehabilitation centers in Vietnam?

Pursuant to Article 35 of Decree No. 116/2021/ND-CP stipulating as follows:

Procedures for receiving voluntary drug addicts at rehabilitation centers
1. Drug addicts aged full 12 years or older and wishing to detox from drug addiction may receive voluntary rehabilitation at rehabilitation centers.

Thus, drug addicts aged full 12 years or older who wish to rehab from drug addiction may receive voluntary rehabilitation at rehabilitation centers.

The order of registration for voluntary rehabilitation at rehabilitation centers as prescribed in Clause 3, Article 35 of Decree No. 116/2021/ND-CP is as follows:

- A drug addict from full 18 years old or a legal representative of a drug addict from full 12 to under 18 years old shall submit 1 set of dossiers as prescribed in Clause 2, Article 35 of Decree No. 116/2021/ND-CP at rehabilitation centers; present the original of one of the identification papers for comparison. Dossier for registration of voluntary rehabilitation include:

+ 01 registration for voluntary rehabilitation;

+ 01 photocopy of one of the identification papers: citizen identification, identity card, passport or birth certificate (for persons aged from full 12 to under 18 years) of the person undergoing rehabilitation.

- Rehabilitation centers receive dossiers, examine, compare and advise on rehabilitation plans; information about rehabilitation services available at the center, the cost of using the center's rehabilitation services, other expenses, contributions and support regime for addicts (if any);

- Drug addicts or legal representatives of drug addicts from full 12 years old to under 18 years old and representatives of rehabilitation centers shall reach agreement and agree to sign drug addiction service contracts;

- The drug addiction service contract must be sent: 01 copy to the drug addict, the legal representative of the drug addict from full 12 years old to under 18 years old, 01 copy to be sent to the People's Committee of the commune where the person undergoing rehabilitation registers for voluntary rehabilitation according to regulations.
