Advance money and distribute salaries and bonuses of officials and employees in Vietnam to the National Fund for Technological Innovation?
Pursuant to Article 3 of Circular 12/2022/TT-BLDTBXH as follows:
“Article 3. Labor management, determination of salary fund, advance of salary fund, distribution of salary and bonus
1. The Fund performs labor management as prescribed in Section 2 of Circular No. 26/2016/TT-BLDTBXH dated September 1, 2016 of the Minister of Labor, War Invalids and Social Affairs guiding the implementation of labor management. salary and bonus for employees working in a one-member limited liability company in which 100% charter capital is held by the State (hereinafter referred to as Circular No. 26/2016/TT-BLDTBXH) ).
2. Officials and employees are entitled to salaries and bonuses from the salary and bonus funds determined by the Fund according to the following provisions:
a) The salary fund (planning and implementing), the advance and distribution of salaries and bonuses to public employees and employees shall comply with the provisions of Article 9, Article 10, Article 13, Section 3 and Section 4 of Circular No. 26/2016/TT BLDTBXH.
b) When determining the planned average salary, the average salary used to calculate the salary fund (planning and implementing) according to the provisions of Articles 9 and 14 of Circular No. 26/2016/TT- MOLISA, the profit target (planned profit, realized profit in the year and realized profit of the preceding year) is calculated by the indicator of the difference between total income and total expenses (hereinafter referred to as MOLISA). for short is the difference between revenue and expenditure) of the Fund.”
Accordingly, the advance payment and distribution of salaries and bonuses of officials and employees in Vietnam to the National Fund for Technological Innovation shall comply with the provisions of the aforesaid regulations.

Profit target when determining the fund, the average salary of the manager of the National Technology Innovation Fund?
Pursuant to Article 6 of Circular 12/2022/TT-BLDTBXH as follows:
“Article 6. Determination of salary, remuneration and bonus funds
1. The determination of the average salary level, salary fund and planned remuneration; salary and remuneration fund for performance; bonus fund; salary, remuneration and bonus to the Fund manager shall comply with the provisions of Articles 3, 9, 11, 12, 14, 15, 16, 17, 18 and in Clauses 1, 3, 4, 5, 6 Article 10 of Circular No. 27/2016/TT-BLDTBXH.
2. When determining the average salary, planned salary fund, and implemented salary fund of a full-time manager as prescribed in Clause 1 of this Article, the profit target (planned profit, profit margin) realized in the year and realized profit of the preceding year) is calculated by the indicator of difference between revenue and expenditure, in which:
a) If the Fund fully meets the following conditions: preservation and development of state capital; pay taxes and other payments to the state budget, deduct the risk reserve fund in accordance with the provisions of law; there was growth in loan balance; If the average labor productivity does not decrease and the difference between revenue and expenditure is higher than that of the preceding year, the planned average salary of a full-time manager is determined as follows:
In there:
- TLbqkh : Planned average salary of full-time managers;
- TLcb: The basic salary of a full-time manager is determined according to Clause 1, Article 10 of Circular No. 27/2016/TT-BLDTBXH;
- Salary: The coefficient of salary increase compared to the basic salary associated with the difference between revenue and expenditure is as follows: if the difference is less than 03 billion VND, the maximum salary is 0.1; if the difference is from 03 billion VND to less than 10 billion VND, the maximum salary is 0.3; If the difference is from 10 billion VND to less than 20 billion VND, the maximum salary is 0.5; If the difference is from 20 billion VND to less than 30 billion VND, the maximum salary is 0.7; If the difference is 30 billion VND or more, the maximum Hln will be calculated as 1.0.
b) In case the Fund does not have growth in loan balance, the average salary is determined not to exceed the basic salary."
Accordingly, the determination of the fund of salary, remuneration and bonus for the manager of the National Technology Innovation Fund shall comply with the above provisions.
Salary arrangement, salary change for the manager of the National Technology Innovation Fund in the near future?
Pursuant to Article 5 of Circular 12/2022/TT-BLDTBXH as follows:
“Article 5. Salary arrangement, salary transfer for full-time fund managers
1. The Fund performs the salary arrangement and salary transfer for full-time managers as prescribed in Section 2 of the Circular No. 27/2016/TT-BLDTBXH dated September 1, 2016 of the Minister of Labor and War Invalids. and the Society guide the implementation of salary, remuneration and bonus regimes for managers of single-member limited liability companies in which 100% of charter capital is held by the State (hereinafter referred to as Circular 27). /2016/TT-BLDTBXH), in which:
a) The Chairman of the Management Council shall arrange salary according to the title of Chairman of the Members' Council;
b) Members of the Management Council shall arrange salaries according to their titles of members of the Members' Council.
2. The Fund temporarily applies the ranking criteria to the group of financial companies (No. 56. Finance companies) issued together with the Joint Circular No. 23/2005/TTLT-BLDTBXH-BTC dated August 31, 2005 of The Joint Committee of the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance shall guide the ranking and salary ranking of full-time members of the Board of Directors, General Director, Director, Deputy General Director, Deputy Director, Accountant. Chief accountants of state-owned companies to rate the Fund.
3. When applying the ranking criteria to the group of financial companies to rank the Fund according to the provisions of Clause 2 of this Article, the profit target shall be replaced by the criterion of the difference between revenue and expenditure.”
Accordingly, the salary arrangement and salary transfer for the managers of the National Technology Innovation Fund in the near future will be implemented in accordance with the above regulations.
Circular 12/2022/TT-BLDTBXH will take effect from August 15, 2022.
