On November 3, 2023, the Minister of National Defense promulgated Circular 82/2023/TT-BQP regulating the adjustment of monthly allowances for military personnel and cryptographic workers who receive salaries as military personnel who have been discharged, demobilized, or retired.

Circular 82/2023/TT-BQP applies to the following subjects:

- Military personnel who have been discharged and are receiving monthly allowance policies as prescribed in Decision 142/2008/QD-TTg by the Prime Minister of the Government of Vietnam on implementing policies for military personnel who participated in the anti-America resistance war with less than 20 years of service in the Army and have been discharged to the locality; Decision 38/2010/QD-TTg by the Prime Minister of the Government of Vietnam amending and supplementing Decision 142/2008/QD-TTg.

- Military personnel and cryptographic workers receiving salaries as military personnel who have been discharged, demobilized, or retired and are currently receiving monthly allowance policies as prescribed in Decision 62/2011/QD-TTg by the Prime Minister of the Government of Vietnam on policies for those who participated in the war to protect the Fatherland, performed international duties in Cambodia, helped Laos after April 30, 1975, and have been demobilized, discharged, or retired.

What is the Level of Monthly Allowance for Military Personnel and Cryptographic Workers under the New Regulations?

According to Clause 1, Article 3 of Circular 82/2023/TT-BQP on the calculation method and level of monthly allowance for military personnel and cryptographic workers:

- Increase the monthly allowance of June 2023 by 12.5% for the subjects prescribed in Clauses 1 and 2, Article 2 of Circular 82/2023/TT-BQP.

- From 17 years to under 18 years, the allowance is 2,494,000 VND/month;

- From 18 years to under 19 years, the allowance is 2,598,000 VND/month;

- From 19 years to under 20 years, the allowance is 2,700,000 VND/month.

Thus, depending on the years of service, military personnel, and cryptographic workers receiving salaries as military personnel who have been discharged, demobilized, or retired will have specific adjustments in accordance with the law.

What is the Current Level of Monthly Allowance for Military Personnel and Cryptographic Workers?

According to Joint Circular 182/2013/TTLT-BQP-BTC, the monthly allowance levels for military personnel and cryptographic workers receiving salaries as military personnel who have been discharged, demobilized, or retired are as follows:

- From 15 years to under 16 years, the allowance is 1,282,000 VND/month;

- From 16 years to under 17 years, the allowance is 1,347,000 VND/month;

- From 17 years to under 18 years, the allowance is 1,411,000 VND/month;

- From 18 years to under 19 years, the allowance is 1,475,000 VND/month;

- From 19 years to under 20 years, the allowance is 1,539,000 VND/month.

How is the Funding for Adjusting the Monthly Allowance for Discharged Military Personnel Regulated?

Article 4 of Circular 82/2023/TT-BQP regulates the funding for adjusting the monthly allowance for discharged military personnel as follows:

The funding for adjusting monthly allowances for subjects prescribed in Circular 82/2023/TT-BQP will be ensured by the state budget. The Ministry of Finance will provide the funding as per the regulations of the Ministry of Labor - Invalids and Social Affairs to authorize the Department of Labor - Invalids and Social Affairs of provinces and cities to disburse to the subjects.

Circular 82/2023/TT-BQP is effective from December 19, 2023. However, the provisions of Circular 82/2023/TT-BQP are implemented from July 1, 2023.
