How is the Lunar New Year 2024 break for workers regulated?
Article 112, Clause 1 of the Labor Code 2019 specifies:
Holidays and New Year break
1. Workers shall have time off work and receive full salary on the following holidays and New Year days:
a) Gregorian New Year: 1 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the Gregorian calendar);
d) International Labor Day: 1 day (May 1 of the Gregorian calendar);
e) National Day: 2 days (September 2 of the Gregorian calendar and 1 contiguous day before or after);
f) Hung Kings' Commemoration Day: 1 day (March 10 of the lunar calendar).

On November 3, 2023, the Government Office of Vietnam issued Official Dispatch 8662/VPCP-KGVX of 2023 which conveys the Prime Minister's opinions on the Lunar New Year and National Day holidays for 2024.
The Prime Minister of Vietnam agreed with the Ministry of Labor - Invalids and Social Affairs in Official Dispatch 4594/LDTBXH-ATLD of 2023 on the Lunar New Year holiday from February 8, 2024, to February 14, 2024, and the National Day holiday from August 31, 2024, to September 3, 2024.
On November 22, the Ministry of Labor - Invalids and Social Affairs issued Notification 5015/TB-LDTBXH of 2023 regarding the Lunar New Year and National Day holidays for 2024 for officials, public employees, and workers.
For workers in companies, the Ministry of Labor - Invalids and Social Affairs indicated that based on practical conditions and the holiday schedule for officials and public employees, employers should arrange the Lunar New Year holiday for workers as follows (employers are encouraged to apply the same holiday schedule for workers as for officials and public employees).
- For the Lunar New Year holiday of 2024:
+ Choose 1 day before the New Year and 4 days after the New Year or 2 days before the New Year and 3 days after the New Year or 3 days before the New Year and 2 days after the New Year.
+ Notify the workers of the Lunar New Year holiday arrangement at least 30 days in advance.
The Lunar New Year 2024 falls on Saturday and Sunday of the week, thus the total number of Tet holidays for workers will be as follows:
*For workers who do not work on Saturdays
- If the company chooses the option of 1 day before the New Year and 4 days after the New Year:
Workers will start their Lunar New Year break from Friday, February 9, 2024 (equivalent to the 30th of December in the Year of the Cat) until Thursday, February 15, 2024 (the 6th of the New Year).
- If the company chooses the option of 2 days before the New Year and 3 days after the New Year:
Workers will start their Lunar New Year break from Thursday, February 8, 2024 (equivalent to the 29th of December in the Year of the Cat) until Wednesday, February 14, 2024 (the 5th of the New Year).
- If the company chooses the option of 3 days before the New Year and 2 days after the New Year:
Workers will start their Lunar New Year break from Wednesday, February 7, 2024 (equivalent to the 28th of December in the Year of the Cat) until Tuesday, February 13, 2024 (the 4th of the New Year).
Thus, workers will have a continuous 7-day break, including 5 days off for the Lunar New Year as mandated by the state and 2 compensatory days off (since it overlaps with the usual weekly Saturday and Sunday holidays).
*For workers who have to work on Saturdays
- If the company chooses the option of 1 day before the New Year and 4 days after the New Year:
Workers will start their Lunar New Year break from Friday, February 9, 2024 (equivalent to the 30th of December in the Year of the Cat) until Wednesday, February 14, 2024 (the 5th of the New Year).
- If the company chooses the option of 2 days before the New Year and 3 days after the New Year:
Workers will start their Lunar New Year break from Thursday, February 8, 2024 (equivalent to the 29th of December in the Year of the Cat) until Tuesday, February 13, 2024 (the 4th of the New Year).
- If the company chooses the option of 3 days before the New Year and 2 days after the New Year:
Workers will start their Lunar New Year break from Wednesday, February 7, 2024 (equivalent to the 28th of December in the Year of the Cat) until Monday, February 12, 2024 (the 3rd of the New Year).
Workers will have a continuous 6-day break, including 5 days off for the Lunar New Year as mandated by the state and 1 compensatory day off (since it overlaps with the usual weekly Sunday holiday).
Note: The above-mentioned Lunar New Year holiday schedule is for reference only. The decision of the specific Tet holiday schedule for 2024 will depend on each company.
How are wages regulated for workers working on the 2024 Tet holidays?
Article 98 of the Labor Code 2019 stipulates wages for overtime work and night work:
Wages for overtime work, night work
1. Workers working overtime are entitled to wage calculated based on the wage unit price or the actual wage for the work being performed as follows:
a) On normal days, at least 150%;
b) On weekly rest days, at least 200%;
c) On holidays, Tet holidays, paid leave days, at least 300% not including the salary of holidays, Tet holidays, paid leave days for workers receiving daily wages.
2. Workers working at night shall be paid an extra at least 30% of the wage calculated based on the wage unit price or the actual wage paid for the work performed during normal working days.
3. Workers working overtime at night shall, in addition to the wage stipulated in clauses 1 and 2 of this Article, be paid an extra 20% of the wage calculated based on the wage unit price or the actual wage of the daytime work performed during normal working days or weekly rest days or holidays, Tet holidays.
4. The Government of Vietnam stipulates the details of this Article.
Thus, according to the above regulation, workers working on the Tet holidays in 2024 shall receive the following wage:
- At least 300% not including the salary of holidays, Tet holidays, paid leave days for workers receiving daily wages.
In case of working at night, workers shall be paid an extra at least 30% of the wage calculated based on the wage unit price or the actual wage paid for the work performed during normal working days and an extra 20% of the wage calculated based on the wage unit price or the actual wage of the daytime work performed during holidays, Tet holidays.
