Cases where changes to motor vehicles are not considered modifications in Vietnam

On December 29, 2023, the Minister of Transport of Vietnam promulgated Circular No. 43/2023/TT-BGTVT dated December 29, 2023 on amendments to Circular No. 85/2014/TT-BGTVT on road motor vehicle modification.

Cases where changes to motor vehicles are not considered modifications in Vietnam 

Amendments to Circular No. 85/2014/TT-BGTVT contain additional regulations on cases where motor vehicles have changes that are not considered modifications. 

Specifically, cases where motor vehicles have changes that are not considered modifications are as follows: 

- Changes to the passenger compartment doors (excluding changes to the position and size of doors); 

- Changes to certain structure of the container: sealing or changing the structure of the container doors, replacing flat corrugated iron covers with wavy corrugated iron covers or vice versa; adding additional corrugated iron covers to the roof frame of the covered vehicle without changing the height of the side walls of the container (Hc) as prescribed in Appendix 1 enclosed with Circular No. 42/2014/TT-BGTVT; installing or removing dust covers for the container of a tipper truck;

- Installing, replacing, or removing the cover of the cargo compartment of a pickup truck without changing the size of the container cavity and the size of the bodywork; 

- Installing additional removable fog lights; 

- Replacing the headlamp with a headlamp that has been certified or declared for conformity in accordance with the National Technical Regulation on optical characteristics of road vehicle headlamps QCVN 35:2017/BGTVT without having to change the structure of the vehicle to ensure the installation;

- Replacing light bulbs in the headlamp with other types of light bulbs with equivalent power consumption without having to intervene or change the structure of the headlamp; 

- Installing optional details or body parts from the vehicle manufacturer without changing the size of the bodywork, excluding cases prescribed in Article 6 of Circular No. 85/2014/TT-BGTVT. The installation shall be carried out under the recommendation of the vehicle manufacturer or a legal representative of the vehicle manufacturer; 

- Changing the style of certain details of the vehicle body: front grille and spoiler; 

- Installing additional wind hoods on the roof of a truck, side steps, exhaust decorations, and decorative guards for lights and signal lights without changing the size of the bodywork of the vehicle.   

If the changes mentioned above do not change the type of vehicles as prescribed in Appendix XI enclosed with Circular No. 85/2014/TT-BGTVT and meet the requirements for technical safety and environmental protection according to the corresponding National Technical Regulations, such vehicles shall be eligible for technical and environmental safety inspection of road traffic motor vehicles for grant of inspection certificates or stamps.

Circular No. 43/2023/TT-BGTVT of the Ministry of Transport of Vietnam comes into force as of February 15, 2024.
