What is compensation rate for damages for infringement of honor, dignity, reputation in Vietnam?

Based on Article 592 of the Vietnam Civil Code 2015, the compensation for damages caused by the infringement of honor, dignity, and reputation is determined as follows:

- Damage caused by infringement of honor, dignity, and reputation includes:

+ Reasonable expenses to limit and remedy the damage;

+ Actual lost or reduced income;

+ Other damages as defined by law.

- The person responsible for compensation when the honor, dignity, and reputation of another person are infringed must compensate for damages as mentioned above and an additional amount to compensate for the mental loss that the person suffers. Compensation for mental loss is agreed upon by the parties; if no agreement is reached, the maximum compensation for one person whose honor, dignity, and reputation are infringed shall not exceed ten times the statutory pay rate regulated by the State.

Hence, the compensation for mental loss is mutually agreed upon by the parties; if an agreement cannot be reached, the maximum compensation for one person whose honor, dignity, and reputation are infringed is determined not to exceed 10 times the statutory pay rate regulated by the State (Currently, the statutory pay rate applied is 2.34 million VND/month according to Article 3 of Decree 73/2024/ND-CP).
