1. What are penalties for the person who commits the act of stealing property (a mobile phone) in Vietnam?

According to the provisions of Article 173 of the Criminal Code 2015 (amended and supplemented in 2017) regarding the penalty framework for the crime of property theft:

(1) Basic penalty framework: Community sentence for up to 3 years or imprisonment from 6 months to 3 years: Anyone who steals property valued between VND 2,000,000 and under VND 50,000,000, or under VND 2,000,000 but falls under one of the following cases:

+ Previously subject to administrative sanctions for acts of property appropriation and commits another offense;

+ Previously convicted of this crime or one of the crimes specified in Articles 168, 169, 170, 171, 172, 174, 175, and 290 of the Criminal Code 2015, and the criminal record has not been expunged;

+ Causing adverse impact on security, order, and social safety;

+ Property is the primary means of livelihood of the victim and their family;

+ Property is an artifact or antique.

(2) Aggravated penalties:

- Imprisonment from 2 years to 7 years: For committing the crime under one of the following circumstances:

+ Organized;

+ Professional nature;

+ Stealing property valued between VND 50,000,000 and under VND 200,000,000;

+ Using deceitful, dangerous methods;

+ Assaulting to escape;

+ Property is a national treasure;

+ Dangerous recidivism.

- Imprisonment from 7 years to 15 years: For committing the crime under one of the following circumstances:

+ Stealing property valued between VND 200,000,000 and under VND 500,000,000;

+ Taking advantage of natural disasters or epidemics.

- Imprisonment from 12 years to 20 years: For committing the crime under one of the following circumstances:

+ Stealing property valued at VND 500,000,000 or more;

+ Taking advantage of wartime or emergency situations.

(3) Additional penalties: The offender may also be fined between VND 5,000,000 and VND 50,000,000.
