What are the rights of primary school students in Vietnam?
According to Article 35 of the primary school Charter, issued with Circular 28/2020/TT-BGDDT, primary school students have the following rights:
[1] The right to education
- To receive education, and learn to develop comprehensively and realize the best potential of themselves; to study at a school, class implementing the elementary education program conveniently for themselves in the area of residence.
- To choose a school or transfer to another school beyond the area of residence if the school can admit them.
- Primary-aged students returning from abroad, children of foreigners studying or working in Vietnam, children with difficult circumstances who have not attended school, if wishing to transfer to an primary school, the principal will organize a level survey for appropriate class placement.
- Students with disabilities are entitled to inclusive education in an primary school; guaranteed conditions for study and training; learning and assessment according to individual education plans.
- Students may shorten the program duration, study at an older age than the prescribed age, and extend study time, and retention.
- Students with excellent physical abilities and extraordinary intellectual growth can be promoted to a higher class within the school. The review procedures for each specific case include:
The student’s parents or guardians submit a request to the school.
The school principal forms a survey and advisory council including the principal or vice-principal, the Parent Representative Committee of the school; the current class teacher, the teacher of the higher class, the health worker, and the Team Captain.
Based on the advisory council's results, the principal completes the dossier and reports to the Head of the Department of Education and Training for review and approval.
- Students with limited academic results, having been directly guided and helped by teachers and parents or guardians but still not completing their academic and training tasks, the teacher will report to the principal for consideration of promotion or retention, and together with the family shall decide appropriate educational measures.
[2] To be protected, cared for, respected, and treated equally, democratically; to be ensured legitimate rights and interests; to be fully informed about their learning and training process; to be provided with conditions regarding time, facilities, hygiene, and safety for studying and training.
[3] To participate in activities to develop individual potential; to express personal opinions and aspirations.
[4] To receive scholarships and social policies as prescribed.
[5] To enjoy other rights as prescribed by law.
What behaviors must primary school students in Vietnam comply with?
According to Article 37 of the primary school Charter, issued with Circular 28/2020/TT-BGDDT, primary school students must comply with the following:
