On September 6, 2024, the Ministry of Education and Training of Vietnam issued Official Dispatch 5154/BGDDT-PC in 2024 (Download) guiding the tasks for the 2024-2025 academic year in Legal Affairs.
05 general tasks for the 2024-2025 academic year in legal affairs include:
(1). Continue to consolidate and strengthen the organization and activities of the current legal departments or clearly determine the establishment of new ones (or not establish new ones) in places that do not yet have legal departments but meet the conditions as prescribed in Decree 56/2024/ND-CP;
Specify the functions, tasks, specific powers, and measures, solutions about policies, conditions to ensure the activities of the legal departments/officers in charge of legal affairs at Departments of Education and Training, higher education institutions, and colleges of education.
(2). Continue to institutionalize the viewpoints and directives of the Communist Party and the State on educational development; collaborate to review and implement the Education Law 2019 and Higher Education Law 2012; implement Conclusion 91-KL/TW in 2024 of the Central Executive Committee on the Conclusion of the Politburo continuing the implementation of Resolution 29-NQ/TW in 2013;
Implement the Teachers' Law and the Educational Development Strategy when issued and approved; enhance the quality of institutional building in education and training, especially the internal documents system in schools.
(3). Focus on reviewing legislative documents to propose adjustments, amendments, supplements, or replacements, promptly handle conflicting, overlapping, inadequate, or outdated contents compared to higher-level documents and the socio-economic development situation.
Enhance the collection of opinions from relevant organizations, individuals, directly affected subjects by projects, draft documents, experts, and scientists in appropriate forms.
Organize impact assessments of the drafting, issuance, and implementation of legislative documents to propose promptly drafting, amendments, supplements, and replacements to the Ministries and higher-level agencies.
(4). Strengthen the dissemination and legal education in accordance with the spirit of the XIII Party Congress documents and the documents of the Central Secretariat Communist Party on legal education; closely follow the key tasks of the education sector for the 2024-2025 academic year;
Focus on propagating and disseminating newly issued legal regulations related to state management in education and training; documents and regulations on administrative reform, digital transformation, cybersecurity, state secrets protection, startup support, laws on complaints and denunciations, land, environmental protection, laws on anti-corruption, waste, drug crimes, epidemics, natural disasters, social vices; organize Vietnam Legal Day.
(5). Enhance the activities of monitoring and evaluating the enforcement of education laws to propose appropriate measures to improve the effectiveness of legal implementation.

What are regulations on organization and building a team of legal affairs of higher education institutions to perform tasks for the 2024-2025 academic year in Vietnam?
According to Section 2, Chapter 2 of Official Dispatch 5154/BGDDT-PC in 2024, higher education institutions organize and build a team of legal affairs staff to perform tasks for the 2024-2025 academic year as follows:
- Consolidate and promote the role of the legal department at the unit;
- Enhance the capacity of the legal affairs team at higher education institutions; assign legal affairs staff to participate in professional training and workshops organized by the Ministry of Education and Training and other Ministries and sectors.
How do higher education institutions in Vietnam advise on legal issues related to the organization, management, and operation of the school?
According to Section 2, Chapter 2 of Official Dispatch 5154/BGDDT-PC in 2024, the Ministry of Education and Training guides higher education institutions to advise on legal issues related to the organization, management, and operation of the school as follows:
- Higher education institutions need to review internal documents to ensure that the regulations in the internal documents have updated relevant new regulations in the Laws, National Assembly Resolutions, Government Decrees, Prime Minister’s Decisions, and Minister’s Circulars; accordingly, plan to amend, supplement internal documents, ensuring the basis for issuance, content, and adjustment scope conform to higher-level documents.
- In case of issuing new Regulations to replace previous ones, they need to clearly identify the new Regulations replacing the old ones to serve as a basis for establishing the rights, obligations, and responsibilities of the subjects implementing the Regulations.
- Recommend higher education institutions focus on standardizing the internal document system (with a specific plan for amendments, supplements, or issuing new documents; have a document on the process of issuing school regulations...).
The standardization of the internal document system serves as the basis for implementing work processes and operations of constituent organizations and of the School, contributing to creating a standard working environment, clarifying the rights and responsibilities of each unit, and individual.
- Research and build new internal documents system ensuring suitability with the current practices of higher education institutions.
At the same time, review the system of documents issued by the School, correctly determine the authority, form, and type of documents for issuance to ensure conformity.
- Advise on implementing autonomy to ensure school governance in accordance with the law, prevent and promptly detect and rectify violations; monitor compliance with the law, implement democratic regulations in activities of higher education institutions, and accountability of the authority according to assigned functions and tasks;
Monitor the management and use of finances and assets of higher education institutions; participate in commenting on draft legal normative documents led by the Ministry of Education and Training.
