Legal Status and Types of Centers
1. Legal status of the Center
a) The Center is an educational institution belonging to the national education system. The Center has judicial personality, its own seal, and account;
b) The Center is managed by the Department of Education and Training.
2. The Center is organized into two types: public and private
a) The public center is invested, ensuring operational conditions and representing the state owner;
b) The private center is invested by domestic or foreign investors and ensures operational conditions.

What is the organizational structure of the Inclusive Education Development Support Center in Vietnam?
According to Article 7 of the Organizational and Operational Regulations of the Inclusive Education Development Support Center issued along with Circular 20/2022/TT-BGDDT, the organizational structure of the Center includes:
- Director, deputy director;
- Functional/specialized departments (or specialized teams, administrative/office teams);
- Classes (if any);
- Communist Party and mass organizations (if any);
- Commendation and reward council, disciplinary council, advisory council (if any).
What are the duties of the Inclusive Education Development Support Center in Vietnam?
Based on Article 5 of the Organizational and Operational Regulations of the Inclusive Education Development Support Center issued along with Circular 20/2022/TT-BGDDT, the Center performs the following duties:
- Assess, determine capabilities, and categorize educational needs for children with signs of defects or functional impairments or disabled students for early educational intervention or guidance in choosing suitable educational methods for each subject.
- Support inclusive education for disabled students.
- Organize teaching and education at the preschool and general education levels for disabled students so that they can participate in inclusive education or integrate into the community.
- Provide training and counseling on psychology, health, education, and vocational guidance for people with disabilities and other organizations, units, or individuals who need it.
- Implement democracy regulations within the Center.
- Implement policies on information, reporting, and accountability to competent authorities, students, learners, and society.
- Perform other duties as prescribed by law.
What Are the powers of the Inclusive Education Development Support Center in Vietnam?
According to Article 6 of the Organizational and Operational Regulations of the Inclusive Education Development Support Center issued along with Circular 20/2022/TT-BGDDT, the Center has the following powers:
- Exercise autonomy rights as prescribed by law and some specific regulations as follows:
+ Decide on the objectives, mission, strategy, and development plans of the Center;
+ Decide on the establishment of the organizational structure according to the Center’s founding proposal approved by competent authorities;
+ Plan, train, and develop the management, teaching, and staff workforce of the Center;
+ Manage finances, invest in developing conditions to ensure the quality of education as prescribed by law;
+ Enroll and manage students and learners; develop the Center's educational programs; organize the compilation, selection of learning materials, toys, and educational tools as prescribed by law;
+ Collaborate with organizations and individuals inside and outside the country to gather resources in expertise or finance to support the Center in fulfilling its duties as prescribed by law.
