Are primary school students in Vietnam entitled to a day off during the Mid-Autumn Festival?
Currently, there is no specific regulation regarding giving students in general or primary school students in particular a day off on the Mid-Autumn Festival.
Additionally, based on Article 112 of the Labor Code 2019:
Holidays
1. An employee is entitled to fully paid leave on the following public holidays:
a) New Year's Day: 01 day (January 01 on the Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 on the Gregorian calendar);
d) International Labor Day: 01 day (May 01 on the Gregorian calendar);
e) National Day: 02 days (September 02 on the Gregorian calendar and 01 adjacent day);
f) Hung Kings Commemoration Day: 01 day (March 10 on the lunar calendar).
2. Foreign employees working in Vietnam, besides the holidays specified in Clause 1 of this Article, are entitled to 01 additional day for their national traditional holidays and 01 National Day.
3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam will specify the holiday dates stipulated at points b and e, Clause 1 of this Article.
The laborer is entitled to fully paid leave on the following public holidays:
- Gregorian New Year: 01 day (January 01 on the Gregorian calendar);
- Lunar New Year: 05 days;
- Victory Day: 01 day (April 30 on the Gregorian calendar);
- International Labor Day: 01 day (May 01 on the Gregorian calendar);
- National Day: 02 days (September 02 on the Gregorian calendar and 01 adjacent day);
- Hung Kings Commemoration Day: 01 day (March 10 on the lunar calendar).
Therefore, Mid-Autumn Festival is not included in the holidays on which the laborer is given leave.
Since students generally follow the teachers' schedule, and according to the aforementioned regulation, teachers do not get a day off on the Mid-Autumn Festival in 2024.
Hence, primary school students do not get a day off on the Mid-Autumn Festival.
However, primary students can participate in activities in the evening after school or take part in activities organized at the school.
What are the evaluation levels for primary students after the Mid-Autumn Festival in Vietnam?
After the Mid-Autumn Festival, students will continue their normal study routine. Therefore, evaluation will still be based on Clause 2, Article 9 of Circular 27/2020/TT-BGDDT, which stipulates the comprehensive assessment of educational results as follows:
Comprehensive assessment of educational results
1. Mid-term I, end of term I, mid-term II, and end of the school year:
a) Subject teachers shall compile regular assessment results and periodic assessment levels of subjects and educational activities to summarize and record the educational outcome of each student in the Comprehensive Assessment Summary Record of the class.
b) Homeroom teachers shall compile regular assessment results and periodic assessment levels for each student's primary qualities and core competencies to summarize and record the educational outcome in the Comprehensive Assessment Summary Record of the class.
2. At the end of the school year, based on the summarized assessment results of each subject, educational activity, and each student's primary qualities and core competencies, the homeroom teacher shall:
a) Assess students' educational results according to four levels:
- Outstandingly Completed: Students who achieve an assessment level of "Outstandingly Completed" in all subjects and educational activities; score 9 or above in the end-of-year periodic tests;
- Well Completed: Students who do not achieve the "Outstandingly Completed" level but achieve "Well Completed" in all subjects and educational activities; score 7 or above in the end-of-year periodic tests;
- Completed: Students who do not achieve the "Outstandingly Completed" or "Well Completed" levels but achieve "Completed" in all subjects and educational activities; score 5 or above in the end-of-year periodic tests;
- Not Completed: Students who do not fall into the above categories.
b) Record remarks, comprehensive assessment results, and any awards given to students during the school year in the Report Card.
Thus, according to the above regulation, the four evaluation levels for primary students are:
- Outstandingly Completed
- Well Completed
- Completed
- Not Completed
Evaluating primary students usually occurs mid-term I, end of term I, mid-term II, and end of the school year.
