PROMULGATING LIST OF TYPES, SCALE-RELATED CRITERIA AND STANDARDS OF ESTABLISHMENTS IN WHICH PRIVATE INVESTMENT IS ENCOURAGED IN EDUCATION - TRAINING, VOCATIONAL TRAINING, HEALTH, CULTURE, SPORTS AND ENVIRONMENT SECTORS

THE PRIME MINISTER OF VIETNAM

Pursuant to the Law on Government Organization dated December 25, 2001;
Pursuant to the Government’s Decree No. 69/2008/ND-CP dated May 30, 2008 introducing incentive policies for making private investment in education, vocational training, health, culture, sports and environment sectors;
In consideration of the request of the Minister of Finance of Vietnam, the Minister of Education and Training of Vietnam, the Minister of Labour, War Invalids and Social Affairs of Vietnam, the Minister of Health of Vietnam, the Minister of Culture, Sports and Tourism of Vietnam, and the Minister of Natural Resources and Environment of Vietnam,

HEREIN DECIDES:

Article 1. The list of types, scale-related criteria and standards of establishments in which private investment is encouraged in education - training, vocational training, health, culture, sports and environment sectors eligible for incentive policies for private investment under Government's Decree No. 69/2008/ND-CP dated May 30, 2008 is enclosed herewith.

During the implementation of this Decision, the lists mentioned in this Article shall be considered and revised to meet private investment and Vietnam’s socio-economic development requirements.

Article 2. This Decision comes into force 15 days after the day on which it is published on Vietnam’s Official Gazette.

Article 4. Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of People’s Committees of central-affiliated cities or provinces shall be responsible for implementation of this Decision./.

1.1.1. Type, scale:

(a) General hospitals: have a scale of at least 31 hospital beds; a hospital located in Hanoi, Ho Chi Minh City, Hai Phong or Da Nang must have a scale of at least 100 hospital beds.

 (b) Specialty hospitals (including social protection centers for the disabled, children, elderly, persons with mental illness, HIV/AIDS patients, or leprosy patients): have a scale of at least 21 hospital beds; a hospital located in Hanoi, Ho Chi Minh City, Hai Phong or Da Nang must have a scale of at least 50 hospital beds.

1.1.2. Standards for health facilities:

 (a) Personnel: comply with regulations adopted by competent authorities. (Currently, the Joint Circular No. 08/2007/TTLT-BYT-BNV dated June 05, 2007 of the Ministry of Health of Vietnam and the Ministry of Home Affairs of Vietnam).

(b) Land, building area and medical devices:

- Land and building area: comply with competent authorities’ regulations applicable to each scale (currently, Decision No. 18/2007/QD-BXD dated May 15, 2007 of the Ministry of Construction of Vietnam promulgating Vietnam’s construction standard TCXDVN 365: 2007 “General hospitals - Design guidelines” and relevant regulations of law in force).

- Medical devices: meet professional conditions laid down in current regulations (currently, Decision No. 437/QD-BYT dated February 20, 2002 of the Minister of Health of Vietnam).

1.2. Clinics: Incentives shall be only given to clinics in extremely disadvantaged areas or disadvantaged areas.

(a) Specialty clinics; traditional medicine diagnosis and treatment centers

(b) Polyclinics with at least 4 specialties and at least 10 hospital beds in disadvantaged areas[1];  polyclinics with at least 3 specialties and at least 8 hospital beds in extremely disadvantaged areas.

2. Preventive medicine facilities

2.1. Type, scale:

(b) Establishments providing disinfection and pest control services; preventive healthcare consulting services; environmental hygiene consulting services; healthcare information and education services: have a scale of at least 5 full-time officers; an establishment located in Hanoi, Ho Chi Minh City, Hai Phong or Da  Nang must have a scale of at least 10 full-time officers.

(c) Establishment providing consultancy, caring and support for HIV/AIDS patients: have a scale of at least 10 full-time officers; an establishment located in Hanoi, Ho Chi Minh City, Hai Phong or Da Nang shall have a scale of at least 15 full-time officers.

2.2. Standards for preventive medicine facilities: comply with criteria and standards for each type issued by competent authorities.

3. Food safety, pharmaceuticals and cosmetics:

3.1. Type, scale:

(a) Establishments providing food safety testing and experimental services: have a scale of at least 10 full-time officers; an establishment located in Hanoi, Ho Chi Minh City, Hai Phong or Da  Nang must have a scale of at least 15 full-time officers.

(b) Establishments providing testing for drugs, cosmetics and medical biologicals; providing bioavailability and bioequivalence assessment services: have a scale of at least 10 full-time officers; an establishment located in Hanoi, Ho Chi Minh City, Hai Phong or Da  Nang must have a scale of at least 15 full-time officers.

3.2. Standards for establishments providing testing and experimental services: comply with criteria and standards adopted by competent authorities.

+ Have legal status recognized and have fulfilled all obligations as prescribed by law.

+ Employ artisans who have a thorough grasp of professional skills and secrets, and experience in teaching traditional professions. Use employees who are fluent in skills and techniques of traditional professions.

+ Have locations for training, teaching and performing folk arts.

Establishments organizing preservation, repair and restoration of relics

+ Have at least 2 architects and civil engineers who have completed training courses in preservation, repair and restoration of relics provided by cultural relics authorities or specialized universities.

+ Have implemented and finished at least 2 relics repair/restoration works per year. These works must be appraised, tested and accepted as prescribed by laws.

+ Be duly established and have fulfilled all obligations as prescribed by law.

+ Be capable of carrying out preservation, repair and restoration of relics as registered with competent regulatory authorities, and have fulfilled all tax obligations as prescribed by laws.

Research and training establishments for cultural heritage conservation

- There at least 45 learners of each training program.

- Theoretical learning classroom must provide a minimum area of at least 1,3m2/learner. Practical training institution must provide a minimum area of at least 2,5 m2/learner.

- There are at least 5 researchers, and 10 lecturers and collaborators in cultural heritage conservation

 

- Be duly established and have fulfilled all obligations as prescribed by law.

- The establishment’s head must have experience in conservation, and be capable of managing and organizing the establishment’s operations in accordance with regulations of law.

- Have facilities and equipment suitable for research and training in heritage conservation.
