REGULATION ON PROTECTION OF PERSONAL DATA OF MEMBERS ON LAWNET.VN

 

- Pursuant to the Government’s Decree No. 13/2023/NĐ-CP dated 17/4/2023 on personal data protection;

- With an aim to lawfully collect, store and use personal data of members, provide better customer care, and protect personal data of members;

  THƯ VIỆN PHÁP LUẬT Company Limited hereby promulgates the Regulation on Protection of Personal Data of Members on LAWNET.VN.

 

Article 1. Consent to LawNet 's collection, storage, use of personal information provided by members

To ensure that you have the best experience on LawNet.vn , we have to collect, store and use the information that has been and will be provided for us during the process of membership registration and communication with employees of LawNet .

Personal information of members are only collected, stored and used their consent.

Article 2. Personal information of members being collected, stored and used

General personal information of a member includes: full name, phone number, email address, gender, mailing address, workplace, taxpayer identification number, browsing history on LawNet.vn . This information is necessary for us to issue invoices and records during the process of using our paid services; making phone calls, sending emails, and supporting members during the use of aw N et's services.

Moreover, we are also entitled to collect and use other information and legal questions provided by members for the purposes of providing legal assistance for members.

Article 3. Purposes of collection, storage and use of personal information provided by members

Members will be asked to give consent before their personal information mentioned in Article 2 of this Regulation is collected, stored and used for the following purposes:

- Member authentication (to remove fake accounts)

- Contacting members to introduce products and services; supporting members during use (by phone, email, etc.)

- Receiving and responding to members' enquiries regarding services and legal issues.

- Issuing invoices and records as prescribed by law.

-Other purposes prescribed by law.

Article 4. Organizations and individuals permitted to collect, manage and use personal information provided by members

Members will be asked to give consent to the collection, management and use of the personal information they provide by (i) LawNet and (ii) other organizations and individuals that have cooperation/association with LawNet (such as post offices, banks, lawyers authorized by members, etc.) in using this information for supporting members during the process of purchase, payment, and use of services of LawNet .

Article 5. Methods for collection, storage and use of personal information provided by members

Members will be asked to give consent to the collection, storage and use of their personal information by any methods that are adopted and/or applied by LawNet and may vary over time, including but not limited to, collection, recording, confirmation, storage, revision, combination, access, extraction, restoration, encryption, decryption, duplication, sharing, transmission, provision, transfer using cyberspace, electronic devices or other means of transferring personal information within Vietnam or abroad, deletion, destruction and other relevant activities.

Article 6. Beginning and ending time of collection, storage and use of personal information provided by members

LawNet will start to collect, store and use personal information of a member as soon as it is registered with, provided for or shared with L LawNet by such member until:

- LawNet receives a written request for termination of collection, storage and use of such personal information from a competent authority; or

- The member withdraws his/her consent in writing as prescribed by law. However, in this case, LawNet is still entitled to store necessary information of such member for execution of contracts signed by the parties; for provision of information upon requests of state agencies (e.g. during invoice inspection by tax authorities, etc.)

The withdrawal of the member's consent in this case does not affect the legality of the collection, storage, and use of personal information previously provided by such member for LawNet .

Article 7. Rights and obligations of members

-Members are entitled to provide, access, revise, delete their personal information; withdraw their consent to the collection, storage, use of their personal information by LawNet ; restrict or object to the collection, storage, use of their personal information, unless otherwise prescribed by law.

-Members have the responsibility to fully and accurately provide their personal information at the request of LawNet in order to facilitate the customer care process.

-Members have other rights and obligations prescribed by law.

Article 8. How to revise members' personal information

Members can revise their personal data associated with their accounts on LawNet.vn themselves, or call 028.7302.2286 or send an email to info@lawnet.vn, or use another appropriate method.

Article 9. Other commitment regarding collection, storage and use of personal information provided by members

LawNet will protect the personal information provided by members in accordance with the law of Vietnam; fully comply with this Regulation, contracts, agreements and other documents signed with members.

LawNet will collect, store and use personal information provided by members only for the specific, unequivocal and lawful purposes stated in this Regulation and in accordance with the law of Vietnam.

During the process of collection, storage and use of personal information provided by members, LawNet and relevant parties will apply necessary technical and security measures within our capacity to protect members' personal information.

However, members must understand the fact that no system or security measure is perfectly safe, and that there are always potential risks to online transactions, cyberspace and any methods for personal information collection, storage and use, including but not limited to, data leaks, breaches, or cyberattack. If all appropriate measures within the capacity of LawNet and relevant parties have been taken, LawNet and relevant parties do not have any liability for the members and their relevant parties (if any).

Article 10. Address of unit collecting, storing and using personal information provided by members

Article 11. Implementation

- This Regulation shall enter into force from September 1 st 2023.

-Contents that are not mentioned in this Regulation shall be implemented in accordance with law.

- Any dispute should be first negotiated in good faith. In case negotiation is not successful, either party is entitled to bring the case to court as prescribed by law.
