Who is the current head of state of Vietnam?

Currently, Vietnamese law does not specify what constitutes a head of state. However, it can be understood that the head of state is the head of state of that country, acting on behalf of the country in domestic and foreign affairs.

Under Article 86 of the 2013 Constitution, the State President is the Head of State, acting on behalf of the Socialist Republic of Vietnam in domestic and foreign affairs.

Thus, the Head of State of Vietnam is the State President of the Socialist Republic of Vietnam.

Accordingly, the current head of state of Vietnam is President Vo Van Thuong.

What are the duties and powers of the head of state of Vietnam?

As stated above, the head of state of Vietnam is the State President.

Under the provisions of Article 88 of the 2013 Constitution, the State President has 06 duties and powers as follows:

- Promulgate the Constitution, laws and ordinances; to request the Standing Committee of the National Assembly to reconsider its ordinances, within ten days of their passage; if those ordinances are still voted for by the Standing Committee of the National Assembly and disapproved by the President, the President shall refer the matter to the National Assembly for decision at its next session;

- Propose to the National Assembly to elect, relieve from duty or remove from office the Vice President or Prime Minister; and, based on resolutions of the National Assembly, appoint, relieve from duty or dismiss Deputy Prime Ministers, Ministers or other members of the Government;

- Propose the National Assembly to elect, relieve from duty or remove from office the Chief Justice of the Supreme People's Court or Procurator General of the Supreme People's Procuracy; and, based on resolutions of the National Assembly, appoint, relieve from duty or dismiss Judges of the Supreme People's Court; appoint, relieve from duty or dismiss Deputy Chief Justices of the Supreme People's Court, Judges of other Courts or Deputy Procurators General or Procurators of the Supreme People's Procuracy; decide on a special amnesty; or, based on resolutions of the National Assembly, proclaim a general amnesty;

- Decide on the award of orders, medals, state prizes or state honorary titles; decide to permit naturalization in Vietnam, renunciation of Vietnamese citizenship, restoration of Vietnamese citizenship or deprivation of Vietnamese citizenship;

- Assume command of the people’s armed forces and hold the office of Chairperson of the National Defense and Security Council; decide on the award, promotion, demotion or deprivation of the ranks of general, naval rear admiral, naval vice admiral and naval admiral; appoint, relieve from duty or dismiss the Chief of the General Staff or the Director of the Political General Department of the Vietnamese People’s Army; based on resolutions of the National Assembly or the Standing Committee of the National Assembly, promulgate or annul decisions to declare a state of war; based on resolutions of the Standing Committee of the National Assembly, issue an order on general mobilization or partial mobilization, declare or cancel a state of emergency; or, in case the Standing Committee of the National Assembly cannot meet, declare or cancel a state of emergency nationwide or in a particular locality;

- Receive foreign ambassadors extraordinary and plenipotentiary; based on resolutions of the Standing Committee of the National Assembly, appoint, relieve from duty; decide to send or recall ambassadors extraordinary and plenipotentiary of the Socialist Republic of Vietnam; confer the ambassadorial title and rank; decide on the negotiation and conclusion of treaties in the name of the State; submit to the National Assembly for ratification of, or decision on the accession to, or withdrawal from, the treaties specified in Clause 14, Article 70; decide on the ratification of, accession to, or withdrawal from, other treaties in the name of the State.

What are the standards for the State President in Vietnam?

(1) General standards:

Pursuant to Section 1 Part I of Regulation 214-QD/TW of 2020 stipulating the general standards for the State President in Vietnam as follows:

- Politics and ideology:

+ Be absolute loyalty to the interests of the Party, the nation - the nation and the people; insist on Marxism-Leninism, Ho Chi Minh's thought, the goal of national independence and socialism, and the Party's renovation line.

+ Have strong political stances, views, and bravery; resolutely protect the ideological foundation, the party's platform, the party's line, the Constitution, and the laws of the state; fight against wrong and hostile views

+ Have a passionate, deep patriotism; always put the interests of the party, the nation, and the people above the interests of sectors, localities, agencies, and individuals; and be willing to sacrifice for the revolutionary cause of the party, for the independence and freedom of the Fatherland, and for the happiness of the people.

+ Absolutely comply with the assignment of the organization and feel secure in the work.

+ Strictly maintain the discipline of speech by the party's principles and regulations.

- Ethics and lifestyle:

+ Be exemplary of moral qualities; live honestly, humbly, sincerely, purely, simply, and tolerantly; and need thrift, integrity, fairness, and impartiality; no ambition for power; be an enthusiastic and highly responsible worker; be a center of solidarity that is exemplary in all aspects.

- No corruption, waste, opportunity, profit; resolutely fight to prevent and repel the deterioration of political ideology, morality, lifestyle, manifestations of "self-evolution" and "self-transformation" internally, bureaucracy, corruption, negativity, waste, rights, and group interests; absolutely do not profiteer and do not let relatives and acquaintances take advantage of their positions and powers for profit.

+ Strictly observe the Party's organizational and disciplinary principles, particularly the principles of democratic centralization, self-criticism, and criticism; properly and fully exercise their powers and responsibilities and direct the strict implementation of principles, regulations, and procedures on cadre work; tenaciously combat manifestations and deeds in cadre work that are contrary to Party and State regulations.

- Qualifications:

Have bachelor's degree or advanced political reasoning; state management of senior specialists or equivalent; appropriate foreign language and computer skills.

- Competence and prestige:

+ Have an objective, comprehensive, dialectical, and historically specific perspective; innovative thinking; strategic vision; scientific working methods; political acumen; have the ability to concretize and lead, direct, and organize the effective implementation of the party's guidelines, guidelines, and policies, as well as the state's laws; and have the ability to summarize practice, conduct theoretical research, analyze data, and forecast effectively.

+ Firmly grasp the general situation and have a comprehensive understanding of the fields, areas, localities, agencies, and units assigned to manage and take charge.

+ Seize opportunities quickly; detect contradictions, challenges, new problems, difficult problems, limitations, and weaknesses in practice; and propose feasible and effective tasks and solutions proactively.

+ Be dynamic, creative, industrious, and hardworking; dare to think, dare to do, and dare to take responsibility; have strong political determination, act decisively, and dare to face difficulties and challenges; saying goes hand in hand with doing; have outstanding achievements; specific results and "products" that contribute significantly to the development of industries, localities, agencies, and units; and be closely associated with the people and for the people.

+ Be the nucleus that gathers and promotes the political system's synergy; be highly trusted and trusted by ministers, Party members, and the general public.

- Health, age, and experience:

+ Be physically fit to perform duties; ensure the age of appointment and introduction of candidates is by Party rules.

+ Have had experience with and successfully performed the responsibilities and duties of the title of leader and key manager of direct subordinates; have extensive practical experience.

(2) Specific standards:

In Section 2 Part I of Regulation 214-QD/TW of 2020, the Specific standards for the State as follows:

- Have high prestige and be the center of unity in the Central Committee, the Politburo, in the whole Party and the people; have the outstanding and comprehensive capacity in all aspects of work, especially in the fields of domestic affairs, foreign affairs, security, and defense; have a deep and broad understanding of judicial affairs.

- Be a center for uniting social forces and ethnic communities at home and abroad; be drastic in leadership, operating according to assigned functions, duties and powers.

- Have experienced and successfully completed their duties during the period of being the secretary of provincial or city Party committee, or head of a central-level department, ministry or branch; have joined the Politburo for a full term or more; special cases shall be decided by the Central Committee of CPV.
