What are the procedures for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam?

On August 23, 2023, the Vietnam Ministry of Foreign Affairs issued Decision 2286/QD-BNG in 2023 on the announcement of new administrative procedures for promulgating diplomatic preferences and immunities within the scope of management functions of the Vietnam Ministry of Foreign Affairs.

The procedures for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam are specified in Section 2 Part 2 of Administrative procedures issued together with Decision 2286/QD-BNG in 2023 as follows:

- The Vietnam Ministry of Foreign Affairs (Directorate of State Protocol or the Department of Foreign Affairs of Ho Chi Minh City) shall receive applications for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam and their family members and maids.

- The Vietnam Ministry of Foreign Affairs (Directorate of State Protocol or the Department of Foreign Affairs of Ho Chi Minh City) shall check the completeness of the application and requests additional documents if necessary.

- Within 30 working days from the date of receipt of a complete and valid application, the Vietnam Ministry of Foreign Affairs (Directorate of State Protocol or the Department of Foreign Affairs of Ho Chi Minh City) shall directly send ID cards to diplomatic missions, consular missions, and representative missions of international organizations in Vietnam.

Methods for submitting the application:

- For diplomatic missions and representative missions of international organizations in Hanoi: register and declare online via the Public Service Portal of the Vietnam Ministry of Foreign Affairs, submit the application directly/send via postal service to the Directorate of State Protocol.

- For consular missions, representative missions of international organizations in the southern provinces (from Da Nang onwards): register and declare online through the Public Service Portal of the Vietnam Ministry of Foreign Affairs, submit the application directly/send via postal service to the Department of Foreign Affairs of Ho Chi Minh City.

What does the application for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam include?

Pursuant to Section 2 Part 2 of the administrative procedures promulgated together with Decision 2286/QD-BNG in 2023, the application for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam includes:

- Diplomatic note of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam: 01 original in the sending country/English and 01 Vietnamese translation.

- Report of loss of ID card certified by the police authority or local authorities (in case of lost ID card).

- Original ID card (in case of ID card renewal).

- 01 color photo 3x4cm.

The time limit for settlement:

- Within 30 working days from the date of receipt of complete and valid documents as prescribed, the Vietnam Ministry of Foreign Affairs (Directorate of State Protocol or the Department of Foreign Affairs of Ho Chi Minh City) shall consider re-issuing ID cards.

Who are the persons applying for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam?

According to Section 2 Part 2 of the administrative procedures promulgated together with Decision 2286/QD-BNG in 2023, the persons applying for reissuing ID cards to members of diplomatic missions, consular missions, and representative missions of international organizations in Vietnam are as follows:

- Diplomatic identity cards shall be issued to:

+ Diplomatic missions diplomats with diplomatic passports indicating their diplomatic ranks; in case diplomatic ranks are not indicated in passports, diplomatic missions introductory diplomatic notes are required;

+ Chief representatives and deputy-chief representatives of representative missions of international organizations, who hold United Nations laissez-passers or national passports (of any kind) which clearly indicate their position of chief representative or deputy-chief representative; in case those laissez-passers or passports do not clearly indicate such position, representative missions introductory diplomatic notes are required;

+ Diplomatic title holders who are on payrolls of Hanoi-based diplomatic missions or representative missions of international organizations and sent to Ho Chi Minh City to take charge of economic, trade, cultural, scientific, and technical affairs, etc.;

+ Spouses and children (offspring or adopted children) aged between 14 and 18 years, of the above-mentioned officials, who have their own passports (of any kind) and live together with those officials in households, on the basis of diplomatic notes of the sending countries Foreign Affairs Ministries or Vietnam-based foreign representative offices;

+ Foreign ambassadors extraordinary and plenipotentiary to Vietnam who do not regularly reside in Vietnam (part-time ambassadors to Vietnam).

- Honorary consul identity cards shall be issued to:

+ Consuls of consular missions based in Ho Chi Minh City or other localities, who hold diplomatic passports indicating their consular-level ranks; in case consular-level ranks are not indicated in passports, representative offices introductory diplomatic notes are required;

+ Diplomatic title holders who are in charge of economic, trade, cultural, scientific or technical affairs, etc., and on payrolls of consular missions based in Ho Chi Minh City and other localities;

+ Spouses and children (offspring and adopted children) aged between 14 and 18 years, the above-mentioned officials who live together with those officials in households and have their own passports (of any kind).

- Honorary consul identity cards may be granted to honorable consuls.

- Honorary consul identity cards and honorary consul identity cards indicate consular zones of consular activities of consuls.

- Official identity cards shall be issued to:

+ Administrative and technical staff members of diplomatic missions, consular missions, and representative missions of international organizations, who hold diplomatic, official or ordinary passports (in case the sending countries do not issue official passports or issue passports of only one kind to their citizens);

+ Spouses and children (offspring and adopted children) aged between 14 and 18 years, of the above-mentioned staff members who have their own passports (of any kind) and live together with those staff members in households, on the basis of diplomatic notes of the sending countries Foreign Affairs Ministries or Vietnam-based foreign representative offices.

- Ordinary identity cards shall be issued to:

+ Service staff members of diplomatic missions, consular missions and representative missions of international organizations, who hold ordinary passports;

+ Spouses and children (offspring and adopted children) of the above-mentioned staff members, who have their own passports and live together with those staff members in households;

+ Overseas Vietnamese who still have Vietnamese nationality while holding foreign passports (of any kind), who are appointed as foreign diplomats, consuls, administrative and technical staff members, or consular staff members;

+ Spouses and children (offspring and adopted children) of the above-mentioned Vietnamese, who hold foreign passports (of any kind) and live together with those Vietnamese in households;

+ Children of diplomats, children of consuls, children of chief representatives and deputy-chief representatives of international organizations, and children of administrative and technical staff members, who are 18 years or older, regardless of the kinds of passports they hold;

+ Private servants of members of representative offices, who are foreigners, regardless of the kinds of passports they hold.
