Pursuant to the provisions of Article 3 of Circular 24/2022/TT-BNNPTNT on appraisal and issuance of the Certificate of animal disease-free zones as follows:
The agency that appraises and issues the Certificate of animal disease-free establishments and zones
1. Department of Animal Health appraises and issues the Certificate of animal disease safety (hereinafter referred to as the Certificate) for:
a) Animal disease-free establishments for export, a mixture of export and domestic consumption;
b) Animal disease-free zones at commune level in service of export, mixed export and domestic consumption;
c) Animal disease-free zones at district and provincial levels.
2. The veterinary specialized management agency of the province shall appraise and issue the Certificate for establishments and zones that are free of animal diseases that do not fall within the scope specified in Clause 1 of this Article.
3. The agency that appraises and issues the Certificate is collectively referred to as the Veterinary Agency.
According to the above regulations, the veterinary agencies of the province will carry out the appraisal and issue the Certificate of animal disease-free zone for the animal disease-free zone at commune, ward, township and zones not serving animals. export, export mix, and domestic consumption.
Pursuant to Clause 1, Article 26 of Circular 24/2022/TT-BNNPTNT has the following provisions:
Dossier for registration of recognition of animal disease-free zones
1. The process of granting the Certificate of animal disease-free zone carried out at the provincial veterinary agencies is now in accordance with the provisions of Clause a, subsection 3, Section B, Part II of the Appendix issued together with Decision 554/QD-BNN-TY in 2023.
As follows:
Step 1: Submit your application
Commune-level People's Committees shall direct specialized agencies and organizations to compile dossiers of registration for recognition of epidemic-free zones and send them to provincial-level specialized veterinary management agencies.
Step 2: Receive and verify the application
Within 05 days from the date of receipt of the application, the veterinary agencies of the province shall receive and appraise the application.
- If the dossier is complete and valid, the provincial veterinary agencies shall notify the People's Committee of the actual assessment plan in the region.
- If the dossier is invalid, the provincial veterinary agencies shall notify in writing the People's Committee for completion.
Step 3: Form an assessment team and go for inspection
Within 10 days after completing the appraisal of the contents of the dossier, the provincial veterinary agencies shall organize an assessment team and conduct the assessment in the region.
Step 4: Assess in the zone
- Direct assessment in the zone:
+ Assess the level of compliance with regulations on animal disease-free zones;
+ Assess the management of information, data and traceability system according to the provisions of Article 24 of Circular 24/2022/TT-BNNPTNT;
+ Take samples for testing if animals show signs of suspected disease or do not ensure biosafety conditions;
+ Make a record and notify the assessment results to the People's Committee, and at the same time report the assessment results in writing to the leader of the veterinary agency;
+ Agree with the People's Committee on the time and content to correct errors with unsatisfactory cases.
- In case of natural disasters, epidemics spreading to humans or dangerous animal diseases, the epidemic must be declared in accordance with the law on veterinary medicine, the assessment shall be carried out as follows:
+ Apply the form of online assessment to the zone that meets the requirements of resources and technical means for implementation (computer, internet connection, software application, audio and video recorder).
+ The President of the People's Committee is responsible before law for the accuracy of information, data, documents, images and records provided to the evaluation team;
+ In case of necessity, the Veterinary Agency shall organize a direct assessment in the zone after the natural disaster or epidemic has been controlled according to the provisions of law.
Step 5: Issue a Certificate of animal disease-free zone
- In case the zone does not have to fix the error:
Within 15 days from the date of completion of the assessment in the region or from the date of receipt of the disease test results, the provincial veterinary agencies shall issue a certificate to the satisfactory region and add the name of the region. on the list of establishments and zones safe from animal diseases; in case the region has unsatisfactory assessment results, the provincial veterinary agencies shall issue a written reply clearly stating the reason.
- In case the zone has to fix the error:
+ Within 05 days from the date of receipt of the report on correction of errors, the veterinary agencies of the province shall receive and appraise the application.
+ If the application is complete and valid, the veterinary agencies of the province shall issue a Certificate of epidemic-free zone according to regulations. In case the dossier is invalid, a written notice shall be sent to the establishment owner for completion.
How long will it take to receive the results of the procedures for granting the Certificate of animal disease-free zones at the provincial veterinary agencies in Vietnam?
Pursuant to the provisions of Clause d, subsection 3, Section B, Part II of the Appendix issued together with Decision 554/QD-BNN-TY in 2023, the time limit for processing the procedures for granting the Certificate of animal disease-free zones implemented at the Provincial Veterinary Agency as follows:
- In case the application is complete and valid; do not have to take corrective action as prescribed: 30 days;
- In case the application is incomplete or invalid; do not have to take corrective action as prescribed: 30 days excluding the time the region completes the dossier;
- In case the application is complete and valid; must carry out remedial measures according to regulations: 35 days excluding the time in the region to carry out the remedial work;
- In case the application is incomplete or invalid; must carry out remedial measures as prescribed: 35 days excluding the time taken by the region to complete the dossier and carry out remedial work.
