What is the procedure for applying for information about land in Vietnam?
According to Circular 34/2014/TT-BTNMT, the procedures for providing land information are carried out according to the following steps:
Step 1. Apply
- Organizations and individuals wishing to exploit land data shall submit a request form or send a written request to the Land Registration Office (the Land Registration Office is organized under the Provincial Department of Natural Resources and Environment and has branches of the Land Registration Office in districts) or the Commune-level People's Committee.
Step 2. Receiving requests
- Upon receipt of the request form, a valid written request of a land data provider organization, individual or agency shall provide data to organizations or individuals requesting data exploitation.
- Civil servants receive, handle and notify financial obligations (in case of having to fulfill financial obligations) to organizations and individuals.
- In case of refusal to provide land information, a written response clearly stating the reasons must be given.
Step 3. Return results
- After organizations and individuals fulfill their financial obligations, land data-providing agencies shall provide land data upon request.
- For cases of data exploitation that need to be synthesized and processed before being provided to organizations and individuals, it must be done in the form of a contract in accordance with the provisions of the Civil Code between land data-providing agencies and organizations and individuals wishing to exploit data.
Settlement deadline:
- Case 1: Receiving the request before 15:00 (03 pm), it must be provided on the same day;
- Case 2: Receiving a request after 15 hours, the provision of land data shall be made on the next working day;
- In case of request to provide land data in the form of information synthesis, the time limit for providing land data shall be determined according to the agreement between the land data provider and the requester in the form of a contract.
Note: This time does not count the following types of time:
+ Receiving dossiers and returning results at commune-level dossier-receiving agencies (communes, wards, towns),
+ Holidays and holidays as prescribed by law;
+ Time for fulfilling financial obligations of land users, time for consideration and handling of land use cases that violate the law, time for requesting assessment
