In 2024, where will the procedures for birth registration be carried out?
Birth registration for Vietnamese citizens residing in Vietnam is carried out at the commune-level People's Committee according to the provisions of Point a, Clause 1, Article 7 of the 2014 Law on Civil Status.
The People's Committee of commune in border areas shall grant birth registration for a child who was born in Vietnam and while a parent is a Vietnamese citizen permanently in such commune, the other parent is a citizen of a neighbor country at the administrative division which is equivalent to commune level in Vietnam and contiguous to the commune in border area of Vietnam where the Vietnamese parent resides according to the provisions of Clause 1, Article 17 of Decree 123/2015/ND-CP.
The birth registration involving foreign elements shall be carried out at the district People's Committee where the father or mother of a child resides according to Clause 2, Article 7 of the 014 Law on Civil Status.
In case the child is a Vietnamese citizen residing abroad, birth registration shall be carried out at the representative mission according to the provisions of Clause 3, Article 7 of the 014 Law on Civil Status.
In 2024, what does the birth registration application in Vietnam include?
Under the regulations in Decision 1872/QD-BTP in 2020, in 2024, the birth registration application is specified as follows:
Birth registration at the commune-level People's Committee
* Documents to be presented:
- Passport or ID card or citizen ID card or other documents with photos and personal information issued by competent authorities, still valid for proving the identity of the applicant;
- Documents proving residence to prove authority to register birth; In case the child's parents have registered their marriage, they must present a Marriage Certificate (during the transition period).
In case of sending the application via the postal system, certified copies of the above-mentioned documents must be enclosed with the application to be presented.
* Documents to be submitted:
- Application form for birth registration made in the specified form.
- Original notice of birth; in case there is no notice of birth, a written statement from the witness certifying the birth shall be submitted; if there are no witnesses, there must be an affidavit of birth;
- In case a child is abandoned, a record of the child's abandonment must be taken by the competent authority.
- In case of birth certificate for a child born through surrogacy, there must be a written certification from the medical institution that has provided assisted reproductive technology for surrogacy.
- An authenticated written authorization as prescribed by law in case of authorization to carry out the procedures for birth registration

- Copies of documents proving identity and documents proving permanent residence in border areas of citizens of neighboring countries.
- An authenticated written authorization as prescribed by law in case of authorization to carry out the procedures for birth registration
Birth registration involving foreign elements
* Documents to be presented:
- Passport or ID card or citizen ID card or other documents with photos and personal information issued by competent authorities, still valid for proving the identity of the applicant.
- Documents proving residence to determine authority to register birth.
- Marriage certificate if the parent has registered the marriage.
- Documents proving the child's lawful entry into Vietnam (such as Passport, valid international travel documents with entry confirmation stamp of the immigration management agency) and a written certification from the competent police authority that the child is residing in Vietnam in case the child is born abroad, whose parents are Vietnamese citizens or the father and mother are both Vietnamese citizens, have not been registered for birth abroad, residing in Vietnam.
In case of sending the application via the postal system, certified copies of the above-mentioned documents must be enclosed with the application to be presented.
* Documents to be submitted:
- Application form for birth registration made in the specified form.
- Original notice of birth; in case there is no notice of birth, a written statement from the witness certifying the birth shall be submitted; if there are no witnesses, there must be an affidavit of birth.
In case a child is born abroad, a notice of birth or other document certifying the child's birth abroad and the mother-child relationship issued by a foreign competent authority is required;
- In case one parent or both parents are foreigners, a written agreement of the parent on the choice of nationality for the child must be submitted.
In case a parent chooses a foreign nationality for their children, in addition to the written agreement on nationality, there must also be a certification from the competent authority of the country where the child is selected for nationality that the child has nationality under the laws of that country;
