Registration Dossier for Vehicle Inspection to Use Electronic Copies in Lieu of Paper Copies When Executing on the Online Public System from August 15, 2022?

I would like to inquire if the online vehicle inspection registration dossier can use the electronic version instead of the paper version? Thank you!

What are the current regulations for vehicle inspection registration documents?

According to Article 10, Circular 86/2014/TT-BGTVT (amended by Clause 1, Article 3, Circular 42/2018/TT-BGTVT), the regulations are as follows:

"Article 10. Inspection Registration Documents

1. The inspection registration documents include the following materials:

a) The original of the Registration for Technical Safety Quality and Environmental Protection Inspection for Imported Vehicle (hereinafter referred to as the Registration for Inspection) according to the form specified in Appendix VI attached to this Circular;

c) A copy certified by the import facility of the introduction document on the features and technical specifications of the vehicle, showing the basic contents: the basic dimensions; the weight parameters (self weight, total weight); the number of allowed passengers; maximum speed; tire size; the distance a vehicle can travel continuously on a single charge (for vehicles using electric motors); introduction of the main systems, including: drive system, brake system, suspension system, steering system, signal lighting system and the basic technical specifications of the engine (for internal combustion engines: maximum power corresponding to the rotational speed, working volume, fuel type used; for electric motors: maximum power, nominal voltage, battery capacity);

If the introduction document on the features and technical specifications of the vehicle cannot be provided or if the document does not meet the content requirements specified at point c of this clause, the import facility shall use the Technical Specifications Registration form specified in Appendix II issued with this Circular as a substitute.

2. The customs declaration according to point b and the components of the dossier specified at point c of clause 1 of this Article may be submitted later than the Inspection Registration form but must be submitted before the vehicle inspection is carried out.

3. Vehicles of the same type as those already inspected and certified by the Vietnam Register are exempt from submitting the document components specified at point c of clause 1 of this Article."

According to Clause 4, Article 8, Circular 16/2022/TT-BGTVT, the regulations are as follows:

"Article 8. Amendment and Supplementation of Certain Articles of Circular No. 86/2014/TT-BGTVT dated December 31, 2014, of the Minister of Transport on conditions for four-wheel motor vehicles transporting people with engine attachment and drivers participating in traffic within restricted areas (hereinafter abbreviated as Circular No. 86/2014/TT-BGTVT and Circular No. 42/2018/TT-BGTVT)

4. Add Clause 4 to Article 10 as follows:

“4. The dossier components specified in clauses 1 and 2 of this Article can be used in electronic form to replace the paper form when processing procedures on the online public service system.”

How is vehicle inspection carried out?

According to Article 11, Circular 86/2014/TT-BGTVT, the regulations are as follows:

"Article 11. Vehicle Inspection

1. Inspection Procedures:

a) Inspection of type conformity of vehicles in the same batch.

b) Inspection of the chassis number and engine number of each vehicle in the batch.

c) Random selection of one sample vehicle in the batch for inspection and testing. For used vehicles, inspection and testing are performed on each vehicle.

2. Inspection and Testing Content:

The inspection and testing of the sample vehicle mentioned at point c of clause 1 of this Article are carried out according to the provisions of Article 4 of this Circular.

3. Exemption from Inspection and Testing in the following cases:

a) Vehicles of the same type that have been inspected under agreements or mutual recognition on standards, regulations, and compatibility that Vietnam has signed;

b) Unused vehicles of the same type as those already certified by the Vietnam Register and from the same import facility.

If a batch of vehicles that belong to the exemption cases mentioned above shows signs of quality non-compliance, sample vehicle inspection and testing must be carried out according to the provisions of clause 2 of this Article."

How is sample vehicle inspection and testing conducted?

According to Article 4, Circular 86/2014/TT-BGTVT, the regulations are as follows:

"Article 4. Sample Inspection and Testing

1. Inspection and Testing Items:

a) For vehicles participating in traffic within restricted areas: Inspection and testing of items specified in Appendix I issued with this Circular;

b) For non-traffic vehicles: Inspection and verification of technical parameters specified in Appendix II issued with this Circular.

2. Testing facilities conduct the sample vehicle inspection and testing according to the correct procedures in correlation with the requirements specified in this Circular; prepare the inspection and testing report according to the prescribed form. If necessary, the Vietnam Register shall directly supervise the inspection and testing.

3. Number of testing samples: One complete sample vehicle (plus one fully charged battery set for electric motor vehicles).

4. After inspection, testing, and preparation of the inspection and testing report, the testing facility returns the sample vehicle and the inspection and testing report to the manufacturing or import facility."

Thus, vehicle inspection registration documents can be used in electronic form to replace paper form when processed on the online public service system from August 15, 2022.

Circular 16/2022/TT-BGTVT takes effect from August 15, 2022.
