New Regulations on Appointment, Dismissal of Leadership Officials and Management Public Employees under the Management of Vietnam Social Security?
On October 1, 2023, the General Director of Vietnam Social Security issued Decision 1388/QD-BHXH 2023 to promulgate the regulations on the appointment, reappointment, transfer, rotation, secondment, dismissal, resignation, temporary suspension of duties and positions for leadership officials, management public employees, and chief accountants at units under the Vietnam Social Security sector.
These regulations apply to leadership officials, management public employees, and chief accountants at units under the Vietnam Social Security (VSS) of Vietnam. Specifically, as follows:
- Leadership officials and management public employees at central units of Vietnam Social Security;- Leadership officials and management public employees at VSS provincial units, cities directly under the Central Government (hereinafter referred to as VSS provinces);- Chief accountants at units under the Vietnam Social Security sector.

What are the new regulations on the tenure of positions in the Vietnam Social Security organizations?
Based on Article 8 of the Regulations on the appointment, reappointment, transfer, rotation, secondment, dismissal, resignation, temporary suspension of duties, and positions for leadership officials, management public employees, and chief accountants at units under the Vietnam Social Security sector issued together with Decision 1388/QD-BHXH 2023, the tenure of positions is regulated as follows:
Tenure of Positions
1. The tenure of leadership and management positions for one term is 5 years (60 months). Chief-level leaders and managers can hold the position for a maximum of 2 consecutive terms at one unit according to the regulations of the Communist Party and specialized laws, other cases are subject to the approval and consideration of the competent authority.
2. The period during which leadership officials and management public employees are assigned to manage a unit does not count towards the appointment tenure for the Chief position at that unit.
3. For leadership officials and management public employees who are transferred, appointed to hold new positions equivalent to the positions currently held at units that are split, merged, reorganized, rebranded, or change leadership titles due to changes in the organization's name, the reappointment timing is calculated from the effective date of the original appointment decision.
Thus, the tenure of positions in the Vietnam Social Security organizations is newly regulated as follows:

Based on Article 5 of the Regulations on the appointment, reappointment, transfer, rotation, secondment, dismissal, resignation, temporary suspension of duties, and positions for leadership officials, management public employees, and chief accountants at units under the Vietnam Social Security sector issued together with Decision 1388/QD-BHXH 2023, the responsibilities and authorities in the appointment and reappointment of leadership officials and management public employees are regulated as follows:
Below are the responsibilities and authorities in the appointment and reappointment of leadership officials and management public employees at units under the Vietnam Social Security sector:
- The collective leadership and the head of the party committee, the unit's organization nominate and evaluate, review the proposed personnel.- The collective leadership, party committee, organization of the unit discuss, evaluate, review the personnel, decide, or recommend the competent authority for consideration and decision.- Individuals and collectives proposing:+ Bear primary responsibility before the competent authority regarding the evaluation, review, coordinate in verifying criteria of political standards, moral qualities, and lifestyle;+ Competence, strengths, weaknesses; asset and income declaration... and their recommendations.- The advisory department on personnel organization: responsible for the results of verification, review, and information screening of the proposed personnel according to their functions, tasks, and authority.- Collective leadership and the head are responsible for human resources decisions. They are accountable for their decisions in appointments and personnel introductions.
