How is the force executing border defense duties understood according to the Vietnam Border Defense Law 2020?
Pursuant to the provisions of Article 6 of the Vietnam Border Defense Law 2020, it is clearly stated as follows:
Force executing border defense duties
1. Agencies, organizations, units of the People's Armed Forces in the border area, border gates.
2. Leading, commanding, and managing agencies of the agencies, organizations, and units of the People's Armed Forces as stipulated in Clause 1 of this Article.
The force executing border defense duties is understood as the People's Armed Forces performing duties in the border area, border gates.
The force executing border defense duties includes:
- Agencies, organizations, units of the People's Armed Forces in the border area, border gates.

What policies does the state have regarding border defense?
Pursuant to the provisions of Article 3 of the Vietnam Border Defense Law 2020, the regulations are as follows:
State policy on border defense
1. Implement policies of independence, sovereignty, unity, and territorial integrity; building peaceful, friendly, cooperative, and developing borders with countries sharing borders; expanding international cooperation, defense diplomacy, security diplomacy, border diplomacy, and diplomacy with the people.
2. Resolve national border issues by peaceful means based on respect for independence, sovereignty, unity, territorial integrity, each other's legitimate interests, in accordance with the Constitution, Vietnamese law, and international treaties to which the Socialist Republic of Vietnam is a member.
3. Use appropriate and legitimate measures to protect the independence, sovereignty, unity, and territorial integrity of the Fatherland.
4. Implement the policy of great national unity; build strong, widespread people's forces to protect national borders, with the people as the core and the People's Armed Forces as the mainstay.
5. Strengthen and enhance national defense and security; prioritize resources for investment, modernize border works, and develop the economy, culture, society, science, technology, and foreign relations in border areas.
6. Mobilize resources from agencies, organizations, and individuals in the execution of border defense duties.
7. Encourage and create conditions for agencies, organizations, and individuals to provide material, financial, and spiritual support for border defense tasks on a voluntary basis, not contrary to Vietnamese law and consistent with international law.
The state has policies as stipulated above regarding border defense.
At the same time, in Article 7 of the Vietnam Border Defense Law 2020, there are also regulations on responsibilities and policies of agencies, organizations, and citizens participating, coordinating, cooperating, and assisting the force executing border defense duties, as follows:
- Agencies, organizations, and citizens are responsible for participating, coordinating, cooperating, and assisting the force executing border defense duties.
- Citizens in border areas are responsible for participating in building the all-people border defense foundation, the all-people border defense posture, and movements to protect sovereignty, territory, national borders, and maintain security, order, and social safety in border areas and border gates.
- Agencies, organizations, and citizens participating, coordinating, cooperating, and assisting the force executing border defense duties who achieve merits shall be rewarded; if they suffer property damage, they will be compensated; if their honor and dignity are harmed, they will be restored; if they suffer injuries, health damage, or loss of life, they or their families will enjoy policies according to the provisions of the law.
What are the principles for executing border defense duties?
Pursuant to Article 4 of the Vietnam Border Defense Law 2020, the principles for executing border defense duties are regulated as follows:
- Comply with the Constitution, Vietnamese law, and international treaties to which the Socialist Republic of Vietnam is a member; respect the independence, sovereignty, territorial integrity, and national borders of other countries.
- Under the absolute and direct leadership in all aspects of the Communist Party of Vietnam and the centralized and unified management of the State.
- Mobilize the combined strength of the entire population, political system, rely on the people, and be subject to the supervision of the people.
- Combine national defense, security with socio-economic development, and socio-economic development with national defense and security; combine the execution of border defense duties with building, consolidating the political system, and developing the economy, culture, society, science, technology, and foreign relations in border areas.
At the same time, Article 8 of the Vietnam Border Defense Law 2020 stipulates the acts that are prohibited regarding border defense, which include:
- Violating national sovereignty, territory; sabotaging, causing instability in security, order, and social safety in border areas and border gates.
- Using or allowing the use of Vietnam's border areas to oppose or intervene in other countries; threatening to use or using force in border relations.
- Impersonating agencies, organizations, and individuals executing border defense duties; opposing, obstructing, retaliating against, threatening, violating the life, health, insulting the honor and dignity of people executing border defense duties.
- Bribing, offering bribes, enticing, dragging, or forcing people executing border defense duties to act against the law.
- Abusing the execution of border defense duties to violate laws, infringe on the interests of the State, and the legitimate rights and interests of agencies, organizations, and individuals.
- Discriminating on gender, dividing, discriminating against ethnic groups, races, nationalities, religions, cultural levels in executing border defense duties.
- Producing, using, trading, exchanging, transporting, disseminating false information, and images about national sovereignty, territory, and borders.
