2024 Tet Holiday Schedule for officials and public employees

The 2024 Tet holiday schedule is as follows:

(1) New Year 2024 holiday schedule:

Based on point a, clause 1, Article 112 of the Labor Code 2019, officials and public employees are entitled to a day off with full pay on New Year's Day: January 1st of the solar calendar. In 2024, New Year's Day falls on Monday, January 1, 2024, and officials and public employees will be off and receive full pay on this day.

However, December 30 and 31, 2023, fall on Saturday and Sunday. Therefore, the New Year holiday schedule for 2024 for officials and public employees (with regular weekends off on Saturday and Sunday) will extend for 3 consecutive days from Saturday, December 30, 2023, to the end of Monday, January 1, 2024.

(2) 2024 Lunar New Year holiday schedule:

On November 22, 2023, the Ministry of Labor, War Invalids and Social Affairs announced the Lunar New Year - Year of the Dragon holiday schedule and the National Day holiday for 2024 for officials, public employees, and workers.

According to Notification 5015/TB-LDTBXH 2023 of the Ministry of Labor, War Invalids and Social Affairs (MOLISA), officials, public employees, and workers will have the 2024 Lunar New Year holiday from Thursday, February 8, 2024 (i.e., the 29th day of the 12th month of the Year of the Cat) to the end of Wednesday, February 14, 2024 (i.e., the 5th day of the first month of the Year of the Dragon).

(The Lunar New Year holiday includes 5 days of Lunar New Year leave and 2 days of compensatory leave for regular weekly rest days, as stipulated in clause 3, Article 111 of the Labor Code 2019).

How is the salary for working during the 2024 Tet holidays calculated?

According to Article 98 of the Labor Code 2019, provisions on overtime pay and night work pay are as follows:

Overtime pay and night work pay

1. Employees working overtime are paid based on the unit price of salary or the actual salary for the job they are doing as follows:

a) On regular working days, at least 150%;

b) On weekends, at least 200%;

c) On public holidays, Tet holidays, and paid leave days, at least 300%, not including the salary for the public holiday, Tet holiday, or paid leave day for employees who receive daily pay.

2. Employees working at night are paid an additional amount of at least 30% of the salary calculated according to the unit price of salary or the actual salary for the regular working day.

3. Employees working overtime at night are paid an additional 20% of the salary calculated according to the unit price of salary or the actual salary for the regular working day or weekend or public holiday or Tet holiday, in addition to the payments as stated in clauses 1 and 2 of this Article.

4. The Government of Vietnam provides detailed regulations for this Article.

In the case of employees working on Tet holidays, they are entitled to a salary of at least 300%, not including the Tet holiday salary for those who receive daily pay.

Furthermore, for employees working at night, they will be paid an additional 30% of the day’s regular wage and 20% of the Tet holiday pay.

Thus, the salary for working during the 2024 Lunar New Year and 2024 New Year holidays will be calculated as follows:

- Working during the day: Receiving at least 400% of the salary.

- Working at night: Receiving at least 490% of the salary.
