How to legally use fireworks during the 2024 Tet holiday in Vietnam?
Currently, there are situations permitted for organizing fireworks displays according to regulations, such as fireworks displays during Tet (Lunar New Year), Hung Kings' Festival, National Day, etc. (according to Article 11 of Decree 137/2020/ND-CP).
Additionally, as per Article 17 of Decree 137/2020/ND-CP, the cases in which individuals are allowed to use fireworks include:
Usage of Fireworks
1. Agencies, organizations, enterprises, and individuals with full civil capacity are allowed to use fireworks in the following cases: Celebrations, festivals, birthdays, weddings, conferences, inaugurations, anniversaries.
2. Agencies, organizations, enterprises, and individuals using fireworks can only purchase them from entities and businesses permitted to produce and sell fireworks.
However, first, individuals must distinguish between fireworks and explosive fireworks to avoid confusion that might lead to legal violations.
According to Clause 1, Article 3 of Decree 137/2020/ND-CP, the regulations about fireworks are as follows:
Terminology Explanation
In this Decree, the following terms are understood as follows:
1. Fireworks are products containing firework powder, when subjected to mechanical, thermal, chemical, or electrical stimuli, they cause rapid, intense chemical reactions, producing gas, and creating sound, light, and color effects in the space, causing an explosion or not. Fireworks include: Explosive fireworks and non-explosive fireworks.
a) Explosive fireworks are products manufactured, both handcrafted or industrially, that when activated by mechanical, thermal, chemical, or electrical stimuli, cause an explosion or produce a hissing sound, an explosion, and color effects in the space;
Explosive fireworks that produce a hissing sound, an explosion, and color effects in the space are called explosive fireworks;
Low-altitude explosive fireworks have a diameter not exceeding 90 mm or a range not exceeding 120 m. High-altitude explosive fireworks have a diameter over 90 mm or a range over 120 m;
b) Fireworks are handcrafted or industrially manufactured products, that when activated by mechanical, thermal, chemical, or electrical stimuli, create sound, light, and color effects in the space, without causing an explosion.
Article 3 of Decree 137/2020/ND-CP explains the two concepts of fireworks and explosive fireworks as follows:
- Explosive fireworks are types of fireworks that produce a hissing sound, an explosion, and color effects in the space.
- Low-altitude explosive fireworks have a diameter not exceeding 90 mm or a range not exceeding 120 m. High-altitude explosive fireworks have a diameter over 90 mm or a range over 120 m.
- Fireworks are products that are handcrafted or industrially manufactured, that when activated by mechanical, thermal, chemical, or electrical stimuli, create sound, light, and color effects in the space, without causing an explosion.
Thus, the fireworks used by individuals differ from explosive fireworks. The fireworks that individuals are permitted to use do not include those that cause explosions. The most significant difference between fireworks and explosive fireworks is that fireworks do not cause explosions or hissing sounds.
Individuals with full civil capacity can purchase and use fireworks from entities and businesses licensed to produce and sell fireworks.
Therefore, during the Tet 2024, individuals are permitted to use fireworks in accordance with Point b, Clause 1, Article 3 of Decree 137/2020/ND-CP, and those fireworks must be purchased from entities and businesses licensed to produce and sell fireworks.
Currently, only Company 21 Chemical One Member Limited Liability (Factory Z121) under the Ministry of Defense of Vietnam is authorized to produce and supply fireworks in our country.

What are administrative penalties for individuals illegally using explosive fireworks in Vietnam?
According to Point i, Clause 3, Article 11 of Decree 144/2021/ND-CP, and Clause 7, Article 11 of Decree 144/2021/ND-CP, the regulations are as follows:
Violations related to the management and use of weapons, explosives, explosive precursors, support tools, fireworks, and prohibited dangerous toys

3. A fine ranging from 5,000,000 VND to 10,000,000 VND for any of the following acts:
a) Exchanging, gifting, donating, depositing, borrowing, leasing, renting, pawning weapons, support tools, explosive fireworks, smuggled fireworks, or firework powder for illegal production of fireworks; components, subcomponents of weapons, support tools, or scrap, waste of weapons, explosives, support tools;
b) Transporting or destroying weapons, explosives, explosive precursors, support tools without ensuring safety or causing environmental impact but not subject to criminal prosecution;
c) Failing to test, inspect, evaluate, and register according to the regulations on quality management of products and goods before being permitted to produce, trade, or use weapons, support tools in Vietnam;
d) Illegally storing, transporting types of scrap, waste of weapons, support tools;
e) Transporting, storing illegal prohibited dangerous toys;
g) Selling explosive precursors to organizations and businesses that have not been granted a Certificate of security and order, Certificate of eligibility for production of industrial explosives, or a License for trading explosive precursors or do not have written approval from the competent state authority;
h) Losing rudimentary weapons, support tools that were equipped;
i) Illegally using fireworks, firework powder;

7. Additional penalties:
a) Confiscation of exhibits and means of administrative violations for acts specified in Points d and dd, Clause 1; Points a, b, c, e and g, Clause 2; Points a, c, d, dd, e, h, i and k, Clause 3; Points a, b, c, d, dd, e, h and i, Clause 4 and Clause 5 of this Article;

According to the above regulations, individuals who illegally ignite explosive fireworks can be fined from 5,000,000 VND to 10,000,000 VND in addition to confiscation of the exhibits and means of administrative violations.
Note: The mentioned fine is applicable to individuals. For organizational violations, the fine is doubled.
