On July 1, 2024, the Government Inspector General of Vietnam issued Circular 07/2024/TT-TTCP, which stipulates the authority and content of inspections on the responsibility for implementing laws on inspections, citizen reception, complaints, denunciations, and anti-corruption.

Circular 07/2024/TT-TTCP applies to the following subjects:

(1) Heads of state management agencies, heads of inspection agencies, heads of inspection teams, and members of inspection teams when inspecting the responsibility for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption.

(2) Heads of agencies, organizations, units, and individuals responsible for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption.

(3) Other relevant agencies, organizations, units, and individuals.

What are the regulations on the authority of the Government Inspectorate of Vietnam to inspect responsibility?

Pursuant to Article 3 of Circular 07/2024/TT-TTCP, the authority of the Government Inspectorate of Vietnam to inspect responsibility is specified as follows:

Authority of the Government Inspectorate of Vietnam to inspect responsibility

1. The Government Inspectorate of Vietnam shall inspect the responsibility for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption for ministries, ministerial-level agencies (hereinafter collectively referred to as Ministries), agencies attached to the Government of Vietnam, People's Committees of provinces and centrally run cities (hereinafter collectively referred to as provincial-level People's Committees).

2. Inspections of the responsibility for implementing anti-corruption laws for enterprises and non-state sector organizations shall be conducted according to the provisions of Clause 4 Article 59 of Decree No. 59/2019/ND-CP dated July 1, 2019, of the Government of Vietnam detailing some articles and measures for implementing the Law on Anti-corruption, and Decree No. 134/2021/ND-CP dated December 30, 2021, of the Government of Vietnam amending and supplementing some articles of Decree No. 59/2019/ND-CP.

The authority of the Government Inspectorate of Vietnam to inspect responsibility includes:

- The Government Inspectorate of Vietnam shall inspect the responsibility for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption for ministries, ministerial-level agencies (hereinafter collectively referred to as Ministries), agencies attached to the Government of Vietnam, People's Committees of provinces and centrally run cities (hereinafter collectively referred to as provincial-level People's Committees).

- Inspections of the responsibility for implementing anti-corruption laws for enterprises and non-state sector organizations shall be conducted according to the provisions of Clause 4 Article 59 Decree 59/2019/ND-CP and Decree 134/2021/ND-CP amending and supplementing some articles of Decree 59/2019/ND-CP.

What are the regulations on the content of inspections for the responsibility for implementing laws on inspection?

Pursuant to Article 9 of Circular 07/2024/TT-TTCP, the content of inspections for the responsibility for implementing laws on inspection includes:

- State management content on inspection:

+ Advisory, construction, issuance, and guidance on implementing regulations on the organization and operation of inspections under their authority (if any);

+ Performing the responsibilities of the heads of state management agencies and heads of agencies performing inspection functions as stipulated by the Law on Inspection;

+ Implementing policies on information and reporting;

+ Establishing, managing, exploiting, using, and storing inspection records and other contents as stipulated by the law on inspection.

- Inspection activities:

+ Organizing, constructing, and issuing inspection plans, implementing inspection plans;

+ Performing duties and powers of inspection decision-makers, heads of inspection teams, and other members of inspection teams during inspections;

+ Issuing inspection decisions; constructing and approving inspection plans; adhering to inspection timelines; inspecting procedures, processes, and steps; reporting inspection results; concluding inspections, publicizing inspection conclusions; handling violations, and monitoring, urging, and checking the implementation of inspection conclusions, recommendations, and handling decisions;

+ Supervising the activities of inspection teams, assessing draft inspection conclusions;

+ Performing the responsibilities of the heads of state management agencies at the same level in issuing documents organizing the implementation of inspection conclusions and directing the implementation of inspection conclusions; handling or requesting, recommending competent state agencies to handle economic violations; handling or requesting, recommending competent state agencies to handle officials and public employees who commit violations of the law; applying or requesting, recommending competent state agencies to apply measures for overcoming shortcomings, improving mechanisms, policies, and laws.

When does Circular 07/2024/TT-TTCP take effect?

Pursuant to Article 14 of Circular 07/2024/TT-TTCP:

- Circular 07/2024/TT-TTCP takes effect from August 15, 2024.

- Circular 07/2021/TT-TTCP ceases to be effective from the effective date of Circular 07/2024/TT-TTCP.

- During the implementation process, if there are difficulties, obstacles, or new arising issues, agencies, organizations, units, and individuals should promptly report to the Government Inspectorate of Vietnam for research, modification, and supplementation.
