Under Article 8 of Circular 05/2022/TT-BTP:
Principles of appointment and salary grading according to professional titles for public employees who are legal assistants
1. Appointment to the professional title for public employees who are legal assistants must ensure meeting the standards of the professional title to be appointed to.
2. When appointing from the current public employee grade to the professional title of legal assistant, salary step upgrade or promotion to the higher professional title of public employees must not be combined.
According to the above regulation, only individuals who meet the standards of the professional title will be appointed to the professional title of legal assistant.

What are the regulations on salary grading for public employees who are legal assistants in Vietnam?
Article 9 of Circular 05/2022/TT-BTP stipulates as follows:
Salary grading
1. The professional title of legal assistant applies the professional payroll applicable to officials and public employees in public service providers of the State (Table 3) issued with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government of Vietnam on salary policies for officials and public employees and armed forces, and Decree No. 17/2013/ND-CP dated February 19, 2013, of the Government of Vietnam on amendments to Decree No. 204/2004/ND-CP. Specifically:
a) The professional title of Grade I legal assistant applies the salary coefficient of public employees of category A3, group A3.1 (salary coefficient from 6.20 to 8.00);
b) The professional title of Grade II legal assistant applies the salary coefficient of public employees of category A2, group A2.1 (salary coefficient from 4.40 to 6.78);
c) The professional title of Grade III legal assistant applies the salary coefficient of public employees of category A1 (salary coefficient from 2.34 to 4.98).
2. The salary grading according to the professional title of public employee according to the provisions of Clause 1 of this Article for public employees already have salaries graded under grades according to Circular No. 06/2010/TT-BNV dated July 26, 2010, of the Minister of Home Affairs regulating the titles, grade codes of legal assistant, Decree No. 204/2004/ND-CP, and Decree No. 17/2013/ND-CP is conducted as follows:
If public employees are eligible for appointment to the professional title with the same salary coefficient as the old grade, the salary step will be the same as the old grade and percentage (%) of extra-seniority allowance (if any) at the old grade (including calculating the time for the next salary step upgrade or considering extra-seniority allowance if any in the old grade) shall retain.
3. Public employees, who after changing the professional title, are appointed to the professional title according to the provisions of this Circular, have salaries graded under the guidance at Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, of the Minister of Home Affairs guiding salary grading when upgrading grade, changing grade, changing types of officials and public employees.
The salary grading for the professional titles of legal assistants will apply according to the following 03 salary coefficients:
- The professional title of Grade I legal assistant applies the salary coefficient of public employees of category A3, group A3.1 (salary coefficient from 6.20 to 8.00);
- The professional title of Grade II legal assistant applies the salary coefficient of public employees of category A2, group A2.1 (salary coefficient from 4.40 to 6.78);
- The professional title of Grade III legal assistant applies the salary coefficient of public employees of category A1 (salary coefficient from 2.34 to 4.98).
If public employees are eligible for appointment to the professional title with the same salary coefficient as the old grade, the salary step at the new professional title will be the same as the old grade; the percentage (%) of extra-seniority allowance at the old grade (if any) shall retain.
What are the salaries paid to legal assistants in Vietnam?
Article 3 of Decree 38/2019/ND-CP stipulates as follows:
Statutory pay rate
1. The statutory pay rate is the basis for:
a) Determining the levels of salaries in payrolls, allowances and other benefits as per the law with regard to individuals as defined in Article 2 hereof;
b) Determining subsistence allowances as per the law;
c) Determining contributions and benefits concerning the statutory pay rate.
2. From July 1, 2019, the statutory pay rate is VND 1,490,000 per month.
3. The Government shall request the National Assembly to consider adjusting statutory pay rate in conformity with the capacity of the state budget, consumer price index and national economic growth rate.
The salaries paid to legal assistants in Vietnam will be calculated based on the statutory pay rate and the salary coefficient.
Therefore, the salaries paid to legal assistants in Vietnam will be as follows:
- The professional title of senior legal assistant (grade I) will have a salary from 9,230,000 VND to 11,920,000 VND.
- The professional title of principal legal assistant (grade II) will have a salary from 6,556,000 VND to 10,102,200 VND.
- The professional title of legal assistant (grade III) will have a salary from 3,486,600 VND to 7,420,200 VND.
Circular 05/2022/TT-BTP will take effect from October 20, 2022
