What is the Resolution 67 2025 on judicial system of Vietnam's People's Court?

On February 6, 2025, the Standing Committee of the National Assembly officially passed Resolution 67/2025/UBTVQH15 which stipulates the levels, conditions for each level, the process of promotion, and the number, structure, and ratio of judges' levels at the People's Courts.

Accordingly, Resolution 67 2025 comes into effect from February 6, 2025. Article 1 of Resolution 67/2025/UBTVQH15...Download defines the levels of judges in the People's Courts as follows:

- First Level Judges of the People's Court;

- Second Level Judges of the People's Court;

- Third Level Judges of the People's Court.

Additionally, in Article 7 of Resolution 67/2025/UBTVQH1, the process of judge promotion in the People's Court must adhere to the following principles:

- Judge promotion is conducted through a review process; ensuring the conditions of each judge level; based on the position, number, and structure ratio of judge levels assigned to each court level and other provisions of Resolution 67/2025/UBTVQH1;

- Ensure transparency, objectivity, and compliance with the law;

- Only promote judges to the next higher level adjacent to the current level;

- Promotion does not apply to judges under disciplinary action or under investigation, prosecution, or trial, or during the period of disciplinary-related provisions by the Communist Party or state law.

Decision-making authority regarding judge promotion and rank assignment in the People's Court is as follows:

- Based on the number of each judge level assigned; conditions and promotion process, and other provisions of this Resolution, the head of the authorized agency or unit as per management decentralization proposes judge rank promotion and assignment;

- Chief Justice of the Supreme People's Court decides on judge rank promotion and assignment.

How many types of court fees are there currently in Vietnam?

According to Article 4 of Resolution 326/2016/UBTVQH14, court fees are classified as follows:

(1) Fees for resolving civil, marriage and family, business, commercial, and labor requests under court jurisdiction as stipulated in clauses 1, 2, 3, 4, 6, 7, 8, 9, and 10 of Article 27; clauses 1, 2, 3, 4, 5, 6, 7, 8, 10, and 11 of Article 29; clause 1 and clause 6 of Article 31; clause 1 and clause 5 of Article 33 of the Civil Procedure Code 2015.

(2) Fees for the recognition and enforcement in Vietnam or non-recognition of foreign court judgments/decisions, or decisions of other competent foreign authorities, or non-recognition of foreign arbitration decisions, including:

- Fees for recognition and enforcement or non-recognition in Vietnam of foreign court judgments, decisions or of other foreign competent authorities as stipulated in clause 5 of Article 27; clause 9 of Article 29; clauses 4 and 5 of Article 31; clauses 3 and 4 of Article 33 of the Civil Procedure Code 2015;

- Fees for appealing court decisions on the recognition and enforcement of foreign court judgments and foreign arbitration decisions in Vietnam.

(3) Fees for resolving requests related to Vietnam commercial arbitration tribunals handling disputes as regulated by arbitration law.

(4) Fees for filing bankruptcy proceedings.

(5) Fees for evaluating the legality of a strike.

(6) Fees for arresting sea vessels and aircraft.

(7) Fees for executing court delegations from foreign courts in Vietnam.

(8) Fees for judicial delegations abroad.

(9) Fees for obtaining copies of documents and photographic copies of documents at the court, including:

- Fees for photocopying documents, evidence in case files made by the court;

- Fees for obtaining copies of judgments, court decisions;

- Fees for obtaining copies of criminal record clearance decisions;

- Fees for obtaining other court documents.

Thus, there are currently 9 types of court fees as per Resolution 326.

How much are court fees in Vietnam in 2025?

Based on section B of the Court Fees and Charges List attached to Resolution 326/2016/UBTVQH14 the court fees are stipulated as follows:
