How many days off are there for Vietnamese tax officials in January 2025?
According to Article 112 of the Labor Code 2019, regulations on holidays and public holidays for which employees are entitled to time off with full salary are stipulated as follows:
Holidays and Public Holidays
- Employees are entitled to take leave and receive full salary on the following holidays and public holidays:
a) New Year's Day: 01 day (January 01 according to the Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 according to the Gregorian calendar);
d) International Labor Day: 01 day (May 01 according to the Gregorian calendar);
đ) National Day: 02 days (September 02 according to the Gregorian calendar and 01 day contiguous to the day before or after);
e) Hung Kings’ Festival: 01 day (March 10 according to the lunar calendar).
- Foreign employees working in Vietnam, in addition to the holidays prescribed in clause 1 of this Article, are entitled to one traditional foreign holiday and one national holiday of their home country.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam will decide on specific days off, as specified in points b and đ of clause 1 of this Article.
Accordingly, Vietnamese tax officials are entitled to a day off on New Year's Day 2025, which falls on Wednesday (January 01, 2025) with full salary.
However, if Vietnamese tax officials wish to take days off on other days, they can do so through the following means:
(1) Paid Leave
According to Article 114 of the Labor Code 2019, employees have between 12 - 16 days of leave if they work full-time for a year. Hence, if an employee still has leave or can request leave in advance, they can use their paid leave for a longer New Year's holiday than stipulated.
(2) Leave Accumulation
According to clause 4 Article 113 of the Labor Code 2019, Vietnamese tax officials can negotiate with their employer to take leave in multiple instances or accumulate up to three years’ worth of leave for one time-off.
If superiors approve accumulated leave, Vietnamese tax officials will receive full salary for the additional days off.
(3) Unpaid Leave
Vietnamese tax officials may negotiate with their agency or superiors to take unpaid leave if they have exhausted their annual leave or wish to conserve their leave days.
Note: taking additional days off by accumulating leave or taking unpaid leave requires negotiation and approval from superiors or the agency they are working for; unapproved absence is considered abandonment of work.

(3) Be dedicated, responsible, honest, objective, and impartial; have correct attitudes and cultural conduct in carrying out missions, public duties, and standard behavior in communication and serving the people;
(4) Lead a healthy lifestyle, be modest, unified; be diligent, thrifty, honest, righteous, unbiased; do not exploit public work for personal gain; avoid bureaucracy, corruption, waste, and negativity.
(5) Consistently strive for educational and professional improvement to enhance quality, knowledge, and abilities.
