Vietnam: Which provisions of Decree 100 are annulled under the Decree 168?

Pursuant to Clause 8, Article 52 of Decree 168/2024/ND-CP, which stipulates amendments and supplements to certain articles of Decree 100/2019/ND-CP on the penalties for administrative violations in the field of road and railway traffic (as amended and supplemented by Decree 123/2021/ND-CP), Decree 168 completely repeals 26 Articles in Decree 100 regarding penalties for administrative violations in the field of road and railway traffic, including:

- Article 5. Penalties for drivers of automobiles and similar vehicles violating road traffic regulations

- Article 6. Penalties for drivers of motorcycles, mopeds (including electric bikes), similar motorcycles, and similar mopeds violating road traffic regulations

- Article 7. Penalties for drivers of tractors, specialized vehicles (referred to as vehicles) violating road traffic regulations

- Article 8. Penalties for drivers of bicycles, electric bicycles, and other rudimentary vehicles violating road traffic regulations

- Article 9. Penalties for pedestrians violating road traffic regulations

- Article 10. Penalties for drivers conducting animals or driving animal-drawn vehicles violating road traffic regulations

- Article 11. Penalties for other violations of road traffic regulations

- Article 16. Penalties for drivers of automobiles (including trailers or semi-trailers being towed) and similar vehicles violating regulations on the conditions of vehicles participating in traffic

- Article 17. Penalties for drivers of motorcycles, mopeds (including electric bikes), similar motorcycles, and similar mopeds violating regulations on the conditions of vehicles participating in traffic

Vietnam: Decree 168 doubles the fines for automobile violations compared to Decree 100?

Starting January 1, 2025, Decree 168/2024/ND-CP stipulating penalties for administrative violations in the field of road traffic has replaced several points, clauses, and articles of Decree 100/2019/ND-CP (as amended and supplemented by Decree 123/2021/ND-CP).

Accordingly, the fines for automobile violations under Decree 168 have increased significantly compared to those under Decree 100. Specifically:

What are the current vehicle registration fees in Vietnam?

Based on Clause 5, Article 8 of Decree 10/2022/ND-CP, which stipulates the registration fees for automobiles, trailers, or semi-trailers towed by automobiles, and similar vehicles will be 2%, except in the following cases:

(1) Automobiles carrying up to 9 people (including pickup cars): the first-time registration fee is 10%.

In cases where a higher fee is deemed necessary to suit local conditions, the local People’s Council may decide to increase the fee up to 50% above the general rate mentioned in this section.

(2) Pickup trucks with a permissible carrying capacity of less than 950 kg and seating up to 5 people, VAN trucks with a permissible carrying capacity of less than 950 kg, pay the first-time registration fee at 60% of the fee applicable to automobiles carrying up to 9 people.

(3) Battery-powered electric vehicles:

+ For 3 years starting from the effective date of Decree 10/2022/ND-CP: the first-time registration fee is 0%.

+ For the subsequent 2 years: the first-time registration fee is 50% of the fee applicable to gasoline or diesel-powered automobiles with the same number of seats.

Note: The vehicles listed in (1), (2), and (3): the second-time onward registration fee is 2%, applied uniformly nationwide.

Based on the type of vehicle indicated in the Certificate of Technical Safety Quality and Environmental Protection issued by the Vietnamese registry, tax authorities will determine the registration fee rates for automobiles, trailers, or semi-trailers towed by automobiles, and similar vehicles as stipulated above.
