Plan 140: Which 05 ministries, departments, or organizations shall cease operations under the downsizing policies of the Government of Vietnam?

On December 05, 2024, the Steering Committee on the Summary of Implementation of Resolution 18-NQ/TW issued Plan 140/KH-BCDTKNQ18...Download regarding the plan to downsize the organizational structure of the Government of Vietnam.

Specifically, according to the orientation plan to downsize the organizational structure of the Government of Vietnam, there is a recommendation to terminate the activities of some ministries, agencies, and organizations in the process of downsizing the Government's structure. Specifically:

(1) Terminate the operation of the Party Committee of the Government of Vietnam, establish the Communist Party Committee of the Government of Vietnam under the central government, comprising party organizations in ministries, agencies equivalent to ministries, agencies under the Government of Vietnam, and some party organizations within state-owned corporations, general companies, and commercial banks (the Communist Party Committee of the Army and the Communist Party Committee of the Public Security remain as they are); a specialized agency for advising and assisting will be established at the Government Office. The Communist Party Committee of the Government of Vietnam includes: the executive committee, the standing committee, the secretary, and the deputy secretary of the party committee; the standing committee of the party committee includes the Prime Minister of the Government of Vietnam as Secretary, the Deputy Prime Ministers of the Government of Vietnam, some members of the Government of Vietnam, and may appoint one dedicated Deputy Secretary; the Politburo assigns personnel for the executive committee and the standing committee of the party committee; stipulates that the standing committee of the party committee performs functions and tasks similar to those of the current Party Committee of the Government of Vietnam.

(2) Terminate the work of party committees, establish Communist Party committees in ministries, agencies equivalent to ministries, and agencies under the Government of Vietnam under the Communist Party Committee of the Government of Vietnam, including: the executive committee, the standing committee, the secretary, and the deputy secretary of the party committee; the standing committee of the party committee includes the Minister as Secretary, Deputy Ministers, Director of the Personnel Department, and one dedicated Deputy Secretary; the competent authority assigns personnel for the executive committee, standing committee, secretary, and deputy secretary of the party committee, stipulating that the standing committee of the party committee performs functions and tasks similar to those of current party committees in ministries, agencies equivalent to ministries, and agencies under the Government of Vietnam.

(3) Terminate the operation of the State Capital Management Committee at enterprises, transferring functions and tasks to the Ministry of Finance, specialized ministries, and relevant agencies.

Implementing this plan involves transferring functions and tasks of exercising ownership representation rights over 19 corporations, general companies currently managed by the State Capital Management Committee at enterprises, to the Ministry of Finance and Developmental Investment or the Ministry of Economic Development; tasks of state management in industries and fields related to the operation scope of corporations, general companies will be managed by relevant ministries to ensure the separation of state management functions from ownership representation functions.

For some major corporations (such as Vietnam Oil and Gas Group - PVN, Vietnam Electricity Group - EVN, Vietnam Posts and Telecommunications Group...), there will be consideration to establish key Communist Party organizations directly under the Communist Party Committee of the Government of Vietnam.

(4) Terminate the operation of the National Financial Supervisory Commission, transferring tasks to the Ministry of Finance, the State Bank of Vietnam, and related agencies.

Implementing this plan involves transferring the tasks of the Commission to the Ministry of Finance and Developmental Investment or the Ministry of Economic Development, and the State Bank of Vietnam. To perform the task of coordinating general supervision of the financial market (including securities, insurance, banking), while specialized laws assign responsibility to ministries and central authorities for industry-specific supervision (the Ministry of Finance supervises the securities and insurance markets; the State Bank of Vietnam supervises banking activities), it is necessary to establish an inter-agency coordination organization headed by Government leaders to direct the overall supervision coordination activities for the financial market.

(5) Terminate the operation of People's Television, National Assembly Television, News Agency Television, VOV Television, and VTC Television, transferring relevant functions and tasks to Vietnam Television and formulating a restructuring Scheme for Vietnam Television to ensure the effective performance of national television duties with appropriate specialty channels.

Standards for the position of General Director

1. Position and responsibilities: The position of General Director is a leadership and management position under the Ministry and is the head of the General Department, responsible for assisting the Minister of Finance in state management and organization of law enforcement in specialized fields nationwide according to the assignment, decentralization, and authorization of the Minister of Finance; accountable to the Minister and the law for all activities of the General Department.

Thus, according to the current regulations, the General Director of the General Department of Taxation of Vietnam is a leadership and management position under the Ministry of Finance and is the head of the General Department, responsible for assisting the Minister of Finance in state management and organization of law enforcement in specialized fields nationwide as stipulated.

What are the duties of the General Director of the General Department of Taxation of Vietnam?

According to Clause 2, Article 4 of the Regulation on the standard of leading positions at the General Department level and equivalent issued with Decision 1155/QD-BTC 2019, it is stipulated as follows:

- Lead and direct comprehensively all levels and units of the General Department in organizing and implementing the functions and duties of the General Department in accordance with the law;

- Organize the division and delegation of tasks to the Deputy General Directors; establish working mechanisms and collaborative relationships among the leadership of the General Department to ensure the successful completion of assigned tasks;

- Propose and recommend to the Ministry of Finance and competent state agencies policies and measures for effectively implementing the duties under the jurisdiction of the General Department;

- Preside over and cooperate with functional agencies in handling and resolving issues arising in management, maintaining regular work relations with units under the Ministry of Finance, and coordinating with local Communist Party committees and authorities during task implementation;

- Manage officials, public employees, workers, and assets of the General Department as prescribed by law and according to the decentralization of the Minister of Finance;

- Perform other tasks as assigned by the Minister of Finance.
