2. What are the criteria for evaluation and classification of public employees in Vietnam?

According to Sections 2 and 5 of Part VII of Instruction 1326/HD-UBDT 2015, public employees are evaluated and classified based on the following criteria:

Regarding the classification of public employee evaluations:

Based on the evaluation results, public employees are classified into the following levels:

- Outstanding task completion;

- Good task completion;

- Task completion with limitations in capacity;

- Failure to complete tasks.

Regarding the criteria for evaluation and classification of public employees:

To classify the evaluation of public employees, the following criteria are considered:

* Outstanding task completion:

- Public employees not holding managerial positions who meet all of the following criteria will be classified as having outstanding task completion:

+ Possess good professional competence and expertise, complete 100% of their assigned work or tasks according to the signed work contract, ahead of schedule, with quality, and in an effective manner; strictly follow tasks assigned by authorities; have a high sense of responsibility; and proactively contribute to the assigned tasks;

+ Successfully complete unexpected tasks;

+ Comply with ethical and professional standards, regulations, internal rules and regulations of the agency or unit, anti-corruption regulations, practice thrift and prevent waste; dedicate themselves to their profession, and work diligently;

+ Comply with the code of conduct for public employees; have a polite and respectful attitude in serving and communicating with the people; have a spirit of solidarity, effective cooperation, and close coordination with colleagues, relevant agencies, and units during the task implementation;

+ Lead or participate in at least one scientific project, plan, topic, or initiative that is applied and brings about effectiveness in professional and occupational work, recognized by authorized agencies.

- Public employees holding managerial positions who meet all of the following criteria will be classified as having outstanding task completion:

+ Meet the criteria specified in Section 5.1.1 of Part VII of Instruction 1326/HD-UBDT 2015;

+ Proactively and creatively contribute to the work organization and implementation;

+ Successfully implement the mechanism of autonomy and responsibility for public service providers according to the law;

+ Manage and lead the assigned agency or unit to complete 100% of the workload, ahead of schedule, with quality, and in an effective manner.

* Good task completion:

- Public employees not holding managerial positions who meet all of the following criteria will be classified as having good task completion:

+ Possess good professional competence and expertise, complete 100% of their assigned work or tasks according to the signed work contract, ensuring progress, quality, and effectiveness; strictly follow tasks assigned by authorities; have a sense of responsibility in carrying out assigned tasks;

+ Successfully complete unexpected tasks;

+ Comply with ethical and professional standards, regulations, internal rules and regulations of the agency or unit, anti-corruption regulations, practice thrift and prevent waste; dedicate themselves to their profession, and work diligently;

+ Comply with the code of conduct for public employees; have a polite and respectful attitude in serving and communicating with the people; have a spirit of solidarity, effective cooperation, and close coordination with colleagues, relevant agencies, and units during the task implementation;

+ Lead or participate in at least one scientific project, plan, topic, or initiative that is applied and brings about effectiveness in professional and occupational work, recognized by authorized agencies.

- Public employees holding managerial positions who meet all of the following criteria will be classified as having good task completion:

+ Meet the criteria specified in Section 5.2.1 of Part VII of Instruction 1326/HD-UBDT 2015;

+ Proactively and creatively contribute to the work organization and implementation;

+ Successfully implement the mechanism of autonomy and responsibility for public service providers according to the law;

+ Manage and lead the assigned agency or unit to complete 100% of the workload, ensuring progress, quality, and effectiveness.

* Task completion with limitations in capacity:

- Public employees not holding managerial positions who meet the following criteria will be classified as having task completion:

+ Have good professional competence and expertise, complete 70% to less than 100% of their assigned work or tasks according to the signed work contract, including tasks that are delayed in progress, have limitations in quality and effectiveness; have a sense of responsibility in carrying out assigned tasks;

+ Successfully complete unexpected tasks;

+ Comply with ethical and professional standards, regulations, internal rules and regulations of the agency or unit, anti-corruption regulations, practice thrift and prevent waste; dedicate themselves to their profession, and work diligently;

+ Comply with the code of conduct for public employees; have a polite and respectful attitude in serving and communicating with the people; have a spirit of solidarity, effective cooperation, and close coordination with colleagues, relevant agencies, and units during the task implementation;

+ Lead or participate in at least one scientific project, plan, topic, or initiative that is applied and brings about effectiveness in professional and occupational work, recognized by authorized agencies.

- Public employees holding managerial positions who meet the following criteria will be classified as having task completion:

+ Meet criteria specified in Section 5.3.1 of Part VII of Instruction 1326/HD-UBDT 2015;

+ Implement the mechanism of autonomy and responsibility for public career units according to the law;

+ Manage and lead the assigned agency or unit to complete 70% to less than 100% of the workload.

* Failure to complete tasks:

- Public employees not holding managerial positions who meet one of the following criteria will be classified as having failure to complete tasks:

+ Complete less than 70% of their assigned work or tasks according to the signed work contract;

+ Not comply with the assigned tasks from authorities in a serious manner; lack a sense of responsibility in carrying out assigned tasks;

+ Perform tasks that do not meet the requirements;

+ Violate procedures, professional regulations;

+ Violate the code of conduct, professional ethics of public employees, causing inconvenience and disturbance to the people to the extent that disciplinary action is required;

+ Commit acts that divide internal unity, causing disunity within the agency or unit;

+ Lack of cooperation with colleagues, relevant agencies, and units during the task implementation, affecting the operational results of the unit;

+ Violate discipline, violate the law to the extent that disciplinary action is required.

- Public employees holding managerial positions who meet one of the following criteria will be classified as having failure to complete tasks:

+ Meet criteria specified in Section 5.4.1 of Part VII of Instruction 1326/HD-UBDT 2015;

+ Have limited or ineffective management and implementation of tasks, do not meet job requirements;

+ Result in disciplinary violations that require disciplinary action;

+ Manage and lead the assigned agency or unit to complete less than 70% of the workload.

Therefore, the purpose of these evaluations is to comprehensively assess the capacity, job performance, and professional ethics of Public employees in order to classify them, provide appropriate rewards and incentives, and improve the effectiveness of the workforce.
