What is Guideline 11/HD-TLD in 2024 on participating in the implementation of grassroots-level democracy by trade unions issued by the Vietnam General Confederation of Labour about?

To exercise the rights and responsibilities of trade unions in participating in the implementation of grassroots-level democracy, contribute to building clean and strong agencies and units, and developing harmonious, stable and progressive industrial relations in enterprises, the Presidium of the Vietnam General Confederation of Labor (hereinafter referred to as the General Confederation) guides "Trade unions participate in the implementation of grassroots-level democracy" in state agencies, public service providers, political organizations, socio-political organizations (hereinafter referred to as agencies and units) and employers (hereinafter referred to as enterprises) that have established internal trade unions or have not yet established internal trade unions (hereinafter referred to as trade unions).

Where:

Trade unions proactively propose to heads of agencies and units to formulate regulations on grassroots-level democracy of their agencies or units (hereinafter referred to as the Regulation) according to the provisions of Articles 46 to 63 of the Law on Implementation of Grassroots-level Democracy 2022. In addition, the Trade Union proposes to add the following contents to the Regulations:

- Publicize support policies of agencies and units for staff working at agencies or units.

- Staff may discuss and decide to participate in clubs, socio-professional organizations, socio-political-professional organizations, and other social organizations by law.

- Staff may use social networks to give opinions in case the agency or unit collects opinions of staff through social networks but not contrary to the provisions of law.

- Staff may use audio and video recording equipment in accordance with the provisions of law when inspecting and supervising the contents specified in Article 56 of the Law on Implementation of Grassroots-level Democracy 2022 unless otherwise provided for by law.

- Organization of staff meetings: staff meetings are organized from the level of divisions, departments, and subordinate units. Agencies and units with 07 or fewer staff are encouraged to organize staff meetings.

What are the responsibilities in conducting staff comment when disclosing information at workplaces in Vietnam?

Under Article 55 of the Law on Implementation of Grassroots-level Democracy 2022, the responsibilities in conducting staff comment when disclosing information at workplaces implementation of democracy are specified as follows:

- The head of a workplace shall have the plan to collect comments and opinions from staff members on the matters specified in Article 53 of this Law, clearly defining the matters subject to staff comment requirements, form of staff comment, method and time limit for implementation and responsibilities for implementation; shall be responsible for directing the receipt and consolidation of opinions and feedback from staff members; shall study, handle and respond to the opinions of participants, and announce explanations, clarifications or responses to staff members.

- The Executive Committee of the Trade Union of the workplace shall cooperate with the head of the workplace in the implementation of the plan for staff comment; supervise the formulation and implementation of the plan for staff comment, the process of collecting opinions, the results of explanation and response to and implementation of the issues on which staff members comment; consult before the head of the workplace decides to impose regulations on implementation of democracy within the workplace.

- Communist party members, and staff members within the workplace shall have the responsibility to play active and exemplary roles in contributing and giving opinions or comments as a basis for competent authorities to decide; monitor, evaluate and supervise the consolidation of, explanation and response to opinions or comments on the matters that have been tabled for staff consultation and the process of implementation of decisions relating to these matters.
