What is Official Dispatch 2068/BYT-BH on support amount and period for enjoying health insurance benefits under Decree 75/2023/ND-CP about?

On April 23, 2024, the Ministry of Health issued Official Dispatch 2068/BYT-BH in 2024.

Under Official Dispatch 2068/BYT-BH, in recent years, the Ministry of Health has received Official Dispatches from several People's Committees of provinces and centrally-run cities and the Ministry of Labor, War Invalids and Social Affairs reflecting some difficulties and obstacles in implementing Decree 75/2023/ND-CP. The Ministry of Health has the following opinions:

On October 19, 2023, the Government of Vietnam promulgated Decree 75/2023/ND-CP on amendments to Decree 146/2018/ND-CP dated October 17, 2018 of the Government on elaboration of the Law on Health Insurance, including:

- Point c, Clause 2, Article 1 of Decree 75/2023/ND-CP stipulates: "Ethnic minorities who are living in communes of Region II, Region III, and extremely disadvantaged villages in ethnic minority and mountainous areas in the 2016-2020 period, but these communes are no longer on the list of communes in Region II, Region III, and extremely disadvantaged villages in ethnic minority and mountainous areas for the period 2021-2025 according to the Prime Minister's decision.".

- Point a, Clause 3, Article 1 of Decree 75/2023/ND-CP stipulates: “The state budget supports at least 70% of health insurance premium for the beneficiaries specified at Point c, Clause 2, Article 1 of Decree 75/2023/ND-CP.

- Clause 3, Article 3 of Decree 75/2023/ND-CP stipulates: "State budget support for the entities specified in Point c, Clause 2, Article 1 of this Decree for 36 months from November 1, 2023".

The above contents are petitions from People's Committees of provinces and centrally-run cities and the Ministry of Labor, War Invalids and Social Affairs; Vietnam Social Security masters and complies with regulations to ensure health insurance benefits for people.

In 2024, who are the family-based health insurance policyholders in Vietnam?

Under the provisions of Article 5 of Decree 146/2018/ND-CP amended by Article 2 of Decree 104/2022/ND-CP, in 2024, family-based health insurance policyholders in Vietnam include:

- Persons whose names are inscribed in the same household registering their permanent residence, except those persons specified in Articles 1, 2, 3, 4 and 6 of Decree 146/2018/ND-CP:

+ Group of health insurance policyholders whose premiums are paid by both employees and employers;

+ Group of health insurance policyholders whose premiums are paid by social insurance agencies;

+ Group of health insurance policyholders whose premiums are paid by the state budget;

+ Group of health insurance policyholders whose premiums are supported by the state budget;

+ Group of health insurance policyholders whose premiums are paid by employees.

- Persons whose names are inscribed in the same household registering their temporary residence, except those persons specified in Articles 1, 2, 3, 4 and 6 of Decree 146/2018/ND-CP and those who have already participated in health insurance as prescribed in Clause 1 of Article 5 Decree 146/2018/ND-CP.

- The following persons eligible for family-based participation in health insurance:

+ Dignitaries, sub-dignitaries and clergy;

+ Persons residing in social relief establishments, except for those defined in Articles 1, 2, 3, 4 and 6 of Decree 146/2018/ND-CP without health insurance premiums supported by the state budget.

In 2024, what is the family-based health insurance premium in Vietnam?

- Under Point e, Clause 1, Article 7 of Decree 146/2018/ND-CP:

Health insurance premium and health insurance premium payment responsibilities
1. Monthly health insurance premium shall be subject to the following regulations:
a) The premium shall be equal to 4.5% of the employee’s monthly pay with respect to those policyholders specified in clause 1, Article 1 of this Decree.
- Employees on sick leaves from at least 14 days per a month in accordance with laws on social insurance shall not be required to pay health insurance premium payments and shall be entitled to health insurance benefits;
- With respect to employees that are detained, held in custody or suspended from work for investigations, consideration of judgement whether they have committed violations against laws, the monthly premium shall be defined as 4.5% of 50% of each employee's monthly pay. In case where a competent authority makes its judgement that none of violations has been committed, the employee shall be required to pay health insurance premium payments in proportion to the accrued pay amount that he/she has received;
b) The premium shall be equal to 4.5% of the retirement pension and incapacity benefit with respect to those policyholders specified in clause 1, Article 2 of this Decree;
c) The premium shall be equal to 4.5% of the monthly pay that an employee receives before his/her pregnancy and parental leave with respect to those policyholders specified in clause 5, Article 2 of this Decree;
d) The premium shall be equal to 4.5% of the unemployment benefit with respect to those policyholders specified in clause 6, Article 2 of this Decree;
dd) The premium shall be equal to 4.5% of the statutory pay rate with respect to those policyholders other than the abovementioned;
e) The health insurance premium of those policyholders defined in Article 5 hereof shall be determined as follows: The first policyholder shall be required to pay 4.5% of the statutory pay rate; the second, third and fourth policyholder shall be required to pay 70%, 60% and 50%, respectively, of the premium of the first policyholder; the fifth and subsequent policyholder shall be required to pay 40% of the premium of the first policyholder.
Any relief or deduction in the health insurance premium as specified in this point shall be granted only if family members participate in the family-based health insurance within the same financial year.

Thus, in 2024, the family-based health insurance premium in Vietnam is specified as follows:

+ The first policyholder shall be required to pay 4.5% of the statutory pay rate; the second, third and fourth policyholder shall be required to pay 70%, 60% and 50%, respectively, of the premium of the first policyholder; the fifth and subsequent policyholder shall be required to pay 40% of the premium of the first policyholder.

+ Any relief or deduction in the health insurance premium as specified in this point shall be granted only if family members participate in the family-based health insurance within the same financial year.

- Under Clause 2, Article 3 of Decree 24/2023/ND-CP, the current statutory pay rate is 1,800,000 VND/month.

However, from July 1, 2024, upon salary reform, the statutory pay rate will be abolished. Therefore, from July 1, 2024, there may be new instructions on family-based health insurance premiums.
