Regarding this issue, LawNet would like to answer as follows:

On January 10, 2024, the Minister of Home Affairs issued Decision 14/QD-BNV on the 2024 Legal Document Development Program of the Ministry of Home Affairs.

Program for formulation of legislative documents for 2024 of the Ministry of Home Affairs in Vietnam

Program for the formulation of legislative documents for 2024 of the Ministry of Home Affairs in Vietnam includes the following contents:

(1) Tasks of units under the management of the Minister

- Amending and supplementing Decision 27/2022/QD-TTg regulating the functions, tasks, powers, and organizational structure of the National Academy of Public Administration under the Ministry of Home Affairs (implemented by the Department of Personnel and Organization)

- Circular abolishing a number of legal documents issued by the Minister of Home Affairs (implemented by the Legal Department)

(2) Tasks of units under the management of Deputy Minister Nguyen Trong Thua

- The Department of Organization and Personnel presides over the implementation of:

+ Develop a Decree on decentralization of state management in a number of fields for Ho Chi Minh City to replace Decree 93/2001/ND-CP.

+ Decree amending and supplementing regulations on deputies in Decree 101/2020/ND-CP and Decree 120/2020/ND-CP.

+ Circular amending and supplementing a number of articles of Circular 12/2022/TT-BNV guiding on leadership and management civil servant positions; shared professional expertise; support and service in agencies, administrative organizations, and job positions with shared professional titles; support and service in public service units.

- The information center presides over the implementation of the Circular regulating card models and the management and use of cards for officials, civil servants, and public employees.

(3) Tasks of units under the management of Deputy Minister Nguyen Duy Thang

- The Department of Civil Servants and Public Employees presides over the implementation of:

+ Circular amending and supplementing Circular 13/2022/TT-BNV guiding the determination of civil servant rank structure.

+ Decree on policies to attract and utilize talented people in state administrative agencies and public service units

+ Circular guiding planning, training, fostering, and arranging the use of Commanders and Deputy Commanders of Commune-level Military Commands and implementing regimes and policies for command positions of the commune-level Military Command.

+ Circular guiding Clause 3, Article 9 of Decree 103/2022/ND-CP regulating schools of state agencies, political organizations, socio-political organizations, and people's armed forces.

+ Dossier requesting the development of the Law on Cadres and Civil Servants (amended) and the Law on Public Employees (amended)

- The Department of Local Government presides over the implementation of the Dossier requesting the development of the Law on Organization of Local Government (amended)

- The Wage Department presides over the implementation of:

+ Decree regulating new salary regimes for cadres, civil servants, public employees, and the armed forces (replacing Decree 204/2004/ND-CP; at the same time proposing amendments and supplements to a number of articles of relevant Decrees (one Decree amends many Decrees) to ensure synchronous and unified implementation of the new salary policy for officials, civil servants, public employees, and the armed forces from July 1, 2024)

+ Circular guiding the implementation of the regional allowance regime

+ Circular guiding the implementation of the salary regime for working at night and overtime for officials, civil servants, and public employees.

+ Circular guiding the work responsibility allowance regime for civil servants and public employees

+ Circular guiding the implementation of converting old salaries to new salaries for officials, civil servants, and public employees

+ Circular guiding the implementation of mobile allowances for officials, civil servants and public employees.

+ Circular guiding the implementation of a salary increase regime for civil servants and public employees.

+ Circular guiding the implementation of the concurrent allowance regime for officials, civil servants, and public employees

+ Circular guiding the excess seniority allowance regime for officials, civil servants, and public employees

+ Circular guiding the allowance regime for cadres, civil servants, and public employees according to the classification of administrative units and according to the classification of public service units

+ Circular guiding occupational allowances for civil servants and public employees

+ Circular guiding the implementation of bonus regimes for officials, civil servants, and public employees

+ Circular guiding the implementation of work allowances in extremely difficult areas

- Department of Records and Archives presides over the implementation of:

+ Law on Archives (amended)

+ Decree detailing a number of articles of the Archives Law (amended)

+ Circular guiding the norms of the number of people working in public service units in the field of archives

+ Circular guiding the structure of civil servants according to public professional titles in the archives industry and field

+ Circular guiding the operation of storing digital archives

+ Circular guiding on revision; organize the use of documents; manage archived documents in cases where agencies or organizations are reorganized, dissolved, or bankrupt.

+ Circular guiding the issuance, re-issuance, and revocation of archives practice certificates and professional training in archives for individuals who are granted archives practice certificates.

(4) Tasks of units under the management of Deputy Minister Trieu Van Cuong

Circular amending and supplementing Circular 18/2014/TT-BNV stipulating the confirmation of the designation of youth volunteer units that have been established and operated in different periods for units whose designation has not yet been determined, the Department of Youth Affairs will preside over the implementation

(5) Tasks of units under the management of Deputy Minister Vu Chien Thang

- The Government Committee for Religious Affairs presides over the implementation of the Circular stipulating the decentralization and authorization of a number of state management tasks on the beliefs and religions of the Ministry of Home Affairs.

- Implementation by the Department of Non-Governmental Organizations

+ Dossier requesting the development of a Law amending and supplementing the Law on Red Cross activities

+ Decree amending and supplementing a number of articles of Decree 93/2019/ND-CP regulating the organization and operations of social funds and charity funds and proposing amendments to Decree 93/2019/ND-CP.
