1. Procedures for total division, partial division and merger of vocational education institutions in Vietnam

Pursuant to Clause 3, Article 10 of Decree 143/2016/ND-CP (amended as per point b, Clause 7, Article 1 of Decree 24/2022/ND-CP), the procedures for total division, partial division and merger of vocational education institutions are as follows:

- Agencies, organizations, or individuals proposing the division, separation, or merger of vocational education institutions must submit the dossier in accordance with Clause 2, Article 10 of Decree 143/2016/ND-CP (amended as per point a, Clause 7, Article 1 of Decree 24/2022/ND-CP) through the online public service portal, via postal services, or directly to the agencies and organizations stipulated in points b, c, and d, Clause 1, Article 8 of Decree 143/2016/ND-CP (amended as per Clause 5, Article 1 of Decree 24/2022/ND-CP);

- Within 10 working days from the date of receiving the dossier, the agencies or organizations stipulated in points b, c, and d, Clause 1, Article 8 of Decree 143/2016/ND-CP (amended as per Clause 5, Article 1 of Decree 24/2022/ND-CP) shall appraise the dossier for the division, separation, or merger of vocational education institutions and submit it to the authorized person stipulated in Clause 3, Article 10 of Decree 143/2016/ND-CP (amended as per point b, Clause 7, Article 1 of Decree 24/2022/ND-CP) for decision on or permission of the division, separation, or merger of vocational education institutions per Form No. 03, Appendix II, issued with Decree 24/2022/ND-CP.

In cases where the dossier is not valid, or the decision for the division, separation, or merger is not granted, a response shall be provided in writing, clearly stating the reason.

2. Guidelines on publicizing and sending Decisions on the total division, partial division and merger of vocational education institutions in Vietnam

The publicizing and sending of decisions on the division, separation, merger, or permission for the division, separation, and merger of vocational education institutions is specifically stipulated in Clause 5, Article 10 of Decree 143/2016/ND-CP (amended as per point d, Clause 7, Article 1 of Decree 24/2022/ND-CP) as follows:

- The Ministry of Labor - Invalids and Social Affairs (Hanoi, Vietnam); ministries, ministerial-level agencies, agencies under the Government of Vietnam, central agencies of socio-political organizations, provincial People's Committees shall publicize the decision on the division, separation, merger, or permission for the division, separation, and merger of vocational education institutions on their respective websites;

- Within 02 working days from the date of issuing the decision on the division, separation, or merger of public colleges or the decision to permit the division, separation, or merger of private colleges, the Ministry of Labor - Invalids and Social Affairs shall send the decision to the managing agency of the college and the provincial People's Committee where the college is headquartered for monitoring and management;

- Within 02 working days from the date of issuing the decision on the division, separation, or merger of vocational education centers or public secondary vocational schools, the ministries, ministerial-level agencies, agencies under the Government of Vietnam, and central agencies of socio-political organizations shall send the decision to the Ministry of Labor - Invalids and Social Affairs (Directorate of Vocational Education) and the provincial People's Committee where the vocational education center or secondary vocational school is headquartered for monitoring and management;

- Within 02 working days from the date of issuing the decision on the division, separation, or merger of public vocational education centers or secondary vocational schools or the decision to permit the division, separation, or merger of private vocational education centers or secondary vocational schools in the locality, the provincial People's Committee shall send the decision to the Ministry of Labor - Invalids and Social Affairs (Directorate of Vocational Education) for monitoring and management.
