Regarding this issue, LawNet responded as follows:

1. Methods of submission of periodic reports in the field of information and communication in Vietnam

According to Article 8 of Circular 02/2023/TT-BTTTT, reports are sent to the reporting agency by one of the following methods in order of priority:

- Send through the Information and Reporting System of the Ministry of Information and Communications.

- Send via email system.

- Send by Fax.

- Send directly.

- Other methods as prescribed by law.

2. Form of periodic reporting in the field of information and communication in Vietnam

Pursuant to Article 7 of Circular 02/2023/TT-BTTTT, periodical reports shall be sent in one of the following forms in order of priority:

- Reports in electronic documents using the digital signatures of competent persons of agencies, organizations, or units and enclosed the file in Word, Excel, or other formats as prescribed in legal documents promulgating the periodical reporting regime.

- Report in writing with the signature of a competent person and stamped by the agency, organization, or unit according to regulations for agencies and organizations that have not yet connected to the Information and Reporting System of the Ministry of Information and Communications.

3. Publication of the list of periodic reporting regimes in the field of information and communication in Vietnam

According to Article 9 of Circular 02/2023/TT-BTTTT, the list of periodic reports (regular reporting regimes) under the promulgation competence of the Government and the Prime Minister or ministries, ministerial-level agencies promulgate according to their competence prescribed by the Ministry of Information and Communications, or implementing agencies and units must be announced and publicized on the portal of the Ministry of Information and Communications according to the following process:

- Agencies and units under the Ministry of Information and Communications are responsible for reviewing and formulating the request for publication of the list of periodical reports specified in the legal documents assigned to preside over the drafting.

- Within 15 (fifteen) days from the effective date of the legal document regulating the reporting regime, the agency or unit in charge of drafting is responsible for submission of the request for publication of the list of regulations on the reporting regime to the Office of the Ministry of Industry and Trade (according to Form No. 01 in Appendix III issued together with Circular 02/2023/TT-BTTTT). Announcement includes:

+ Name of the report;

+ Objects of reporting;

+ The agency receiving the report;

+ Frequency of making reports;

+ The document stipulating the reporting regime.

- The Office of the Ministry shall review and summarize it and submit it to the Ministry's leadership for consideration and signing of the decision on publication (under the form No. 02 Appendix III issued together with Circular 02/2023/TT-BTTTT) no later than 20 (twenty) days from the effective date of the legal document regulating the periodical reporting regime.

- The Information Center is responsible for posting, updating, and maintaining the list of periodical reporting regimes on the Ministry's web portal.

4. Application of information technology in the implementation of periodic reporting in the field of information and communication in Vietnam

Pursuant to Article 10 of Circular 02/2023/TT-BTTTT stipulating the application of information technology in the implementation of the periodical reporting regime in the field of information and communication, as follows:

- Agencies, units, organizations, enterprises, individuals, and related subjects are responsible for enhancing the application of information technology in implementing the periodical reporting regime, progressing to the implementation of electronic reports, creating favorable conditions for the synthesis and sharing of information, and saving time and costs for the reporting subjects.

- The legal value of electronic reports and the use of electronic signatures comply with the provisions of the law.
