Violation of regulations on enlistment may be fined up to 75 million VND in Vietnam

The government has just issued Decree 37/2022/ND-CP amending the Decree regulating the sanctioning of administrative violations in the field of national defense and defense; state border management and protection; in maritime, island and continental shelf areas of Vietnam.

According to this Decree, violations of regulations on enlistment in Vietnam are administratively sanctioned as follows:

(1) A fine of between 30,000,000 VND and 40,000,000 VND is imposed for failure to be present at the time or place of concentration specified in the enlistment order without plausible reasons.

(2) A fine of from 40,000,000 VND to 50,000,000 VND is imposed for fraudulent acts aimed at evading the implementation of an enlistment order in Vietnam after obtaining the results of medical examination for military service eligible for enlistment in accordance with regulations.

- A fine of between 50,000,000 VND and 75,000,000 VND is imposed for non-compliance with the enlistment order, except for the cases specified in Clause (1) and (2) above.

In addition, violators may also be subject to remedial action for compulsory military service in Vietnam.

(Currently, Decree 120/2013/ND-CP stipulates a fine of between 1,500,000 VND and 2,500,000 VND for not being present at the right time or place of concentration stated in the call for enlistment without a good reason in Vietnam).

Decree 37/2022/ND-CP takes effect from July 22, 2022.
