Persons Wrongfully Convicted Have the Right to Request Honor Restoration Procedures

The Ministry of Justice has just announced new procedures related to the field of State compensation, which include the procedure for restoring honor as stipulated in Decision 1442/QD-BTP issued on June 28, 2018.

The wrongfully convicted person is entitled to have their honor restored through the State's proactive implementation of the honor restoration or by the wrongfully convicted person's own request for the State to restore their honor.

In the case of restoring honor upon request, the wrongfully convicted person must submit a written request using Form 01/BTNN issued in conjunction with Circular 04/2018/TT-BTP.

The agency directly managing the public service officer causing the damage organizes the public apology and correction, and/or publishes the public apology and correction in accordance with the provisions of Article 56, Article 58, and Article 59 of the Law on State Compensation Liability 2017.
