On May 17, 2024, the Minister of Finance issued Circular 40/2024/TT-BTC guiding the payment methods for certain expenses from the state budget for overseas students, learners studying abroad under training and retraining schemes, in cases where it is not possible to transfer funds abroad.
To be specific, in Article 3 of Circular 40/2024/TT-BTC, in instances where it is not possible to transfer funds abroad for overseas students and learners studying abroad, ministries, agencies, and organizations assigned to implement training and capacity-building tasks and schemes abroad as stipulated in Clauses 1 and 2, Article 2 of Circular 40/2024/TT-BTC shall submit proposals to the State Treasury for the procedure to disburse funds to overseas students and learners (including living expenses and overseas health insurance) in US dollars (USD) into personal accounts of the overseas students and learners opened at banks in Vietnam.
The ministries, agencies, and organizations bear comprehensive responsibility for the accuracy, honesty, and legality of the proposal documents sent to the State Treasury, while ensuring compliance with current legal regulations on foreign exchange management.
The levels of living expenses and health insurance provided to overseas students and learners are implemented in accordance with the regulations in the Circulars of the Ministry of Finance regarding the management and use of state budget funds to perform training and capacity-building tasks abroad as follows:
- Point 3.2, Section II, Part II of Joint Circular 144/2007/TTLT-BTC-BGDĐT-BNG and Clauses 3 and 4, Article 1 of Joint Circular 206/2010/TTLT-BTC-BGDĐT-BNG.
- Clauses 3 and 4, Article 4 of Circular 88/2017/TT-BTC guiding the financial mechanism for implementing the training and capacity-building scheme for science and technology personnel domestically and abroad using the state budget.
- Point b, Clause 1, Article 5 of Circular 54/2022/TT-BTC regarding the management and use of regular expenditure funds from the state budget to carry out training and capacity-building schemes for talents in the fields of culture, arts, and sports.
- Clauses 3 and 4, Article 3 of Circular 30/2022/TT-BTC guiding the financial mechanism for implementing the training and capacity-building scheme for university faculty and management staff to meet the requirements of fundamental and comprehensive educational reform.
- Points a and b, Clause 2, Article 7 of Circular 42/2023/TT-BTC stipulating the financial mechanism for implementing leadership and management training using the state budget.
- Other regulations on the levels of living expenses and overseas health insurance stipulated in other tasks and training and capacity-building schemes abroad as per the regulations of competent authorities (if any).
The ministries, agencies, and organizations assigned to implement the training and capacity-building tasks abroad are responsible for managing the funds to disburse to overseas students and learners, ensuring accuracy in the target, content, and budget level as stipulated; monitoring and managing the disbursed amounts, ensuring no duplicate payments, and deducting the corresponding disbursed amounts in Vietnam from the total funds the learners are entitled to under the stipulated policies.
Upon determining the timing for transferring funds (living expenses, health insurance) abroad for overseas students and learners, the ministries, agencies, and organizations assigned to implement the training and capacity-building tasks abroad shall cooperate with the State Treasury to cease implementing the payment method as stipulated in Clause 1, Article 3 of Circular 40/2024/TT-BTC, and resume transferring funds (living expenses, health insurance) abroad for overseas students and learners in accordance with current regulations in the Circulars of the Ministry of Finance on the management and use of state budget funds for implementing training and capacity-building tasks abroad.
