Recently, the Government of Vietnam has issued the Decree No. 148/2020/NĐ-CP on amendments and supplements to several decrees, providing detailed regulations on implementation of the Land Law.
According to Clause 11 Article 1 of the Decree No. 148/2020/NĐ-CP supplementing Article 14a of the Decree No. 43/2014/NĐ-CP detailing a number of articles of the Land Law of Vietnam on principles of allocation and lease of small parcels managed by the State as follows:
- Prioritizing small land plots put under the State control for public uses. In case any land plot cannot be used for public purposes, it shall be allocated or assigned to authorized land users of adjacent land plots for a charge or rental;
- Allocating or leasing land through the auctioning of land use rights in case there are two or more adjacent land users wishing to use small land plots; allocating or leasing land through any approaches other than the auctioning of land use rights in cases where only one person has the need to use land;
- Allocation and lease of small land parcels to adjacent land users shall be carried out after the People's Committees at all levels have checked with, made public announcement to and collected public opinions from people at localities where land plots are located;
- Allocation and lease of small land parcels to adjacent land users shall be carried out after receiving applications for land allocation or lease from adjacent land users, and must ensure conformance to public disclosure, transparency and democracy rules;
