Amendments to regulations on administrative sanctions for consumer protection violations in Vietnam

On February 21, 2025, the Government of Vietnam issued Decree 24/2025/ND-CP amending Decree 98/2020/ND-CP, which prescribes penalties for administrative violations in commercial activities, production, trading of counterfeit goods, banned goods, and consumer protection.

Amendments to regulations on administrative sanctions for consumer protection violations in Vietnam

Additional regulations are introduced for violations concerning the protection of vulnerable consumers as follows:

- A fine ranging from 30,000,000 VND to 50,000,000 VND will be imposed for any of the following violations concerning vulnerable consumers:

+ Failure to prioritize the receipt, handling, or referral of a vulnerable consumer's requests to a third party not obligated to resolve the issue when the consumer requests protection accompanied by evidence proving they are a vulnerable consumer and that their rights have been infringed;

+ Refusing to address requests from vulnerable consumers without providing a written response, or providing a written refusal that lacks legal grounds or does not align with publicly announced policy content as required;

+ Failing to ensure the rights of vulnerable consumers in the process of purchasing products, goods, or services as stipulated by law;

+ Failing to apply legally compliant mechanisms for resolving complaints and disputes tailored to each type of vulnerable consumer;

+ Denying requests for protection from vulnerable consumers due to language, script, custom, or cultural differences;

+ Failing to establish or issue procedures, methods, or measures suitable for each type of vulnerable consumer to ensure their rights to file complaints, request dispute resolutions, and exercise other rights;

+ Failing to develop, update, or publicly disclose to vulnerable consumers the contents, mechanisms, and policies applicable to them as required, or failing to train and prepare employees on these contents, mechanisms, and policies as stipulated.

- A fine ranging from 50,000,000 VND to 70,000,000 VND will be imposed for acts of discrimination or exploitation of the vulnerable factors of consumers to infringe upon their legitimate rights and interests during transactions.
