Below is the content mentioned in the Law on Inspection 2022 approved by the National Assembly of Vietnam on November 14, 2022.
Specifically, the person making the inspection decision shall issue a decision to suspend the inspection in the following cases:
- The subject of the inspection is a deceased person; the agency or organization has been dissolved or has gone bankrupt without any other agency, organization, or individual assuming its rights and obligations;
- The superior inspection agency has completed the inspection contents;
- The investigating authority has decided to file a criminal case based on the same inspection contents.
- The heads of state management agencies at the same level must request in writing that the inspection be halted.
In case of overlap or duplication, which has been handled according to the provisions of Article 55 of the Law on Inspection 2022.
Note: When suspending the inspection, the person conducting the inspection is responsible for canceling the measures taken according to his or her authority during the inspection process.
The decision to halt the inspection must be communicated to the inspected subject.
The Law on Inspection 2022 takes effect on July 1, 2023, and replaces the Law on Inspection 2010.
