Deliberately refusing to check medical examination for military service shall be subject to a fine of up to VND 15 million in Vietnam.

Government enacted Decree 37/2022/NĐ-CP amending the Decree regulating the sanctioning of administrative violations in the field of national defense, essential agencies;... In particular, the intentional failure to attend medical examination for military service shall be subject to a fine of up to VND 15 million in Vietnam.

Specifically, Clause 8, Article 1 of Decree 37/2022/ND-CP (amending Article 6 of Decree 120/2013/ND-CP), the sanction for violation of regulations on examination and medical examination of military service in Vietnam is as follows:

- A fine of between VND 10,000,000 and VND 12,000,000 shall be imposed for acts of failure to be present at the time or place of inspection and medical examination specified in the call for inspection or medical examination of military service of the commander of the district military command board under the provisions of the Law on Military Service without plausible reasons.

(Currently, the fine for the above violation in Vietnam is only from VND 800,000 to VND 1,200,000.)

- A fine of from VND 12,000,000 to VND 15,000,000 shall be imposed for intentional non-acceptance of orders for inspection and medical examination of military service by the commander of the district military command board in accordance with the Law on Military Service without plausible reasons. (New regulation added in Vietnam)

- A fine of between VND 15,000,000 and VND 20,000,000 shall be imposed for one of the following acts in Vietnam:

+ A person who receives a medical examination commits a fraudulent act that falsifies his/her health classification results in order to evade military service;

+ Giving money, property, or other material benefits worth less than VND 2,000,000 to officers, medical personnel or other persons to falsify the health classification results of the inspected person or the person being examined for military service in order to evade military service in Vietnam.

(Currently, the fine for acts related to falsifying the results of medical examination for military service only applies a fine of from VND 2,000,000 to VND 4,000,000.)

- A fine of from VND 25,000,000 to VND 35,000,000 shall be imposed for failure to comply with a call for examination and medical examination of military service. (New regulation added in Vietnam)

Decree 37/2022/ND-CP takes effect from July 22, 2022.
