Regulations on time limit for holding dialogues at enterprises in HCMC, Vietnam

The Vietnam General Confederation of Labor has just issued Official Dispatch 1333/LDLD-CSPL on directing the organization of conferences of cadres, civil servants and public employees; employee conference in 2023.

The time limit for holding dialogues at enterprises in Ho Chi Minh City is as follows:

Pursuant to Instruction 41/HD-TLD dated 11/11/2021, "The Trade Union participates in dialogue and implements grassroots democratic regulation at the workplace" within enterprises, organizations, non-public non-business units, and cooperatives that hire and employ workers.

In order to implement the grassroots democracy regulation at the workplace through the organization of the employee conference, the conference of cadres, civil servants, and public employees in 2023 in accordance with regulations

The Standing Board of the City Confederation of Labor requested the grassroots trade unions and affiliated trade unions guide the grassroots trade unions to coordinate with heads of agencies, units, and employers in organizing the conference of cadres, civil servants, and public employees in 2023 with the following specific contents:

1. Organizing employee conferences and dialogues at enterprises in Vietnam

- In 2023, the organization of the employee conference and dialogue at the enterprise must adhere to the provisions of Decree 145/2020/ND-CP, which details and guides the implementation of a number of Labor Code articles on labor conditions and labor relations.

- Time to organize the Conference of Employees: Enterprises are encouraged to organize the conference (which can be in person or online but must record the conference content) before March 31, 2023.

In cases of legitimate reasons, the conference may be extended, but not beyond May 31, 2023.

For non-public education and training institutions, the employee conference for the school year 2022–2023 will be completed before November 30, 2023.

- The superior trade union shall, on the basis of a report on implementation results (under the form), send it to the City Labor Confederation (via the Policy and Law Department) before June 30, 2023.

2. Organizing conferences of cadres, civil servants, and public employees in Vietnam

- For organizations, administrative units, and non-business units:

+ The organization of the Conference of Cadres and Civil Servants in 2023 must comply with the provisions of Decree 04/2015/ND-CP on the implementation of democracy in the activities of state administrative agencies and public non-business units. The deadline for implementation is no later than December 31, 2022.

- For school block units:

The organization of the Conference of Cadres and Civil Servants in 2023 must comply with the provisions of Decree 04/2015/ND-CP and Circular 11/2020/TT-BGDDT guiding the implementation of democracy in the operation of public educational institutions. Implementation period: from October 14 through November 30, 2022.

- The organization of the Civil Servant Conference in 2023 must ensure democracy, practicability, correct form, order, content, and composition, as specified in Circular 01/2016/TT-BNV.

- The superior trade union shall report the implementation results (under the form) to the City Labor Confederation (via the Policy and Law Department) no later than January 15, 2023.

3. Activities of the People's Inspection Committee of Vietnam

Trade unions at all levels organize and operate the People's Inspection Committees according to the provisions of the Law on Inspection 2010, Decree 159/2016/ND-CP, which details a number of articles of the Law on Inspection on the organization and operation of the People's Inspection Committee, and Instruction 1271/HD-TLD dated 07/8/2017 of the General Confederation of Trade Unions on the Trade Union Guidelines on the organization and operation of the People's Inspection Committee.

The City Federation's Standing Committee proposed that grassroots trade unions and the Communist Party of Vietnam organize implementation and summarize the report results (via the Policy and Law Department) within the time frame specified.
