New: From October, selling alcoholic beverages to persons under 18 in Vietnam shall be punished

In order to synchronize with the provisions of the Law on Prevention and Control of Harmful Effects of Alcoholic Beverages 2019 of Vietnam, it will soon apply fines for selling beer to people under 18 years old.

Specifically, according to Clause 1 Article 30 of the Decree No. 98/2020/NĐ-CP of Vietnam’s Government:

Article 30. Other violations against regulations on trade in alcoholic beverages

1. A fine ranging from VND 500.000 to VND 1.000.000 shall be imposed for selling or providing alcoholic beverages to persons under 18.

According to Point b Clause 1 Article 45 of Decree No. 185/2013/NĐ-CP of Vietnam’s Government, the fine of only between VND 500,000 and 1,000,000 shall be imposed on “Sale of alcohol products for persons not yet sufficient 18 years of age”.

Thus, from October 15, 2020, a fine ranging from VND 500.000 to VND 1.000.000 shall be imposed for selling or providing alcoholic beverages to persons under 18.

This is one of the new highlights of Decree No. 98/2020/NĐ-CP that replaces the provision of Decree No. 185/2013/NĐ-CP. This content is to synchronize with the regulation banning “consumption of alcoholic beverages by persons under 18 years of age”; “selling, supplying and offering discounts on alcoholic beverages to minors” stipulated in the Law on Prevention and Control of Harmful Effects of Alcoholic Beverages 2019 of Vietnam.

Besides, according to Article 30 of the Decree No. 98/2020/NĐ-CP of Vietnam’s Government, a fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed failing to report or submitting false reports on production or trade in spirits having at least 5.5% ABV to the relevant licensing authority.

A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for committing one of the following violations:

- Using an automatic vending machine to sell alcoholic beverages;

- Trading in alcoholic beverages at the premises where the trade in alcoholic beverages is prohibited;

- Employing persons under 18 to produce or trade in alcoholic beverages.
