Pursuant to the provisions of the Land Law 2013 and relevant guiding regulations, the procedures for rectification of the LURC at the district-level land use right registration office are carried out as follows:

(1) In case of direct procedure:

- Land users and owners of assets attached to land shall submit applications to the Land Use Right Registration Office under the Division of Natural Resources and Environment for rectification.

In case the land use right registration office detects that the certificate, certificate of house ownership, or certificate of ownership of construction works that has been issued contains errors, then notify the land user and request that the land user and owner of property on land submit the issued Certificate for rectification.

- The land use right registration office is responsible for checking, making a record of conclusions on the contents and causes of errors, making a application and submitting it to the competent authority for rectification in the issued Certificate with errors, and at the same time rectification of incorrect contents in cadastral records and land databases.

In case of rectification, but the certificate holder requests to change it to Certificate of land use rights, ownership of houses, and other land-attached assets, the land use right registration office shall submit it to the competent authority for issuance of a certificate of land use rights, ownership of houses, and other land-attached assets.

- The land use right registration office issues certificates to land users and owners of assets attached to land.

(2) For the case of carrying out procedures in the electronic environment:

The application-receiving and handling agency shall have to carry out the administrative orders and procedures on land in accordance with the land law; In case it is necessary to check, verify, clarify, or due to other reasons, the result of application settlement is not returned in accordance with regulations on time for settling administrative procedures for land, the application-receiving agency, handling procedures shall send a notice in writing, via the Public Service Portal, or via SMS to the requester, clearly stating the reason.

Land users and owners of assets attached to land are responsible for fulfilling their financial obligations as prescribed by law, either directly or online through the payment function of the Public Service Portal.

The receiving agency or the application-settling agency shall notify the requester to carry out administrative procedures to submit the original of the issued Certificate and the prescribed papers after the land user fulfills his financial obligations.

The return of results of administrative procedures shall be made at the application-receiving agency or through the public postal service, or at the requested location for the case of receiving applications and returning results of settlement of procedures for registration of land and other land-attached assets.

What types of documents are included in the LURC rectification application in Vietnam?

Application for rectification of red number includes the following documents:

- The original of the issued Certificate.

- An application for rectification of the book, in case errors are detected due to the fault of the land user or owner of property on land.
