In Vietnam, the red book (or certificate of land use rights, ownership of houses and other land-linked production) must be corrected in which cases? What is the procedure for correcting red book?

1. Cases subject to correction of red books in Vietnam

According to Clause 1 Article 106 of the 2013 Law on Land, a competent agency shall correct the granted red book with errors in the following cases:

- There is wrong information on the name, legal documents or personal identity, address of the land user, owner of property on land compared with the legal documents or personal identity papers at the time of issuing the red book of such person;

- There is wrong information on the land parcel and property on land compared with the registration dossier of land and property on land which has been verified and certified by the land registration agency.

2. Red book correction procedures in Vietnam

Red books shall be corrected according to the following procedures:

- Land users and land-attached asset owners shall submit the granted books with errors to the land registration offices for correction.

In case errors are made due to the fault of land users or owners of land-attached assets, land users or owners of land-attached assets shall make a written request for correction.

If the land registration office detects errors in the granted red book, it shall notify such to the land user and request the land user or land-attached asset owner to submit the granted red book for correction.

- Land registration offices shall check and make written records of conclusions on contents and causes of errors; make dossiers and submit them to competent agencies for correction in red books which are granted errors and, at the same time, correct errors in cadastral records and land database.

- For corrections requested by the red-book grantees to replace them into other red-book, the land registration office shall submit them to the competent agency for granting the red-book.
